I. LA GARANTÍA LIMITADA DE ELLU APLICA A: ELLU Company 2019, S.L. (en lo sucesivo ELLU Company, o ELLU indistintamente) a) Ley del Consumidor relacionada con esta garantía: La garantía limitada de ELLU no restringe ni limita las normas establecidas en ciertas jurisdicciones, en las que los consumidores y usuarios han adquirido dere- chos en virtud de su legislación nacional aplicable o en virtud de las regulaciones aplicables a la venta de productos de consumo, tanto on-line como off-line, entre otras, la aplicación de las siguientes Directivas europeas 99/44/CE, 2011/83/UE. Estos derechos no se ven afectados por las disposiciones relativas a la Garantía limitada de ELLU que se enumeran a continuación. b) ¿Cuándo aplica la garantía limitada de ELLU?: La garantía limitada de ELLU solo puede ser solicitada por el COMPR ADOR ORIGINAL para los NUEVOS productos ELLU incluidos en el paquete de venta (en lo sucesivo, el “Producto”). ELLU le garantiza que, durante el periodo de Garantía, ELLU o una una entidad debidamente autorizada por ELLU, reemplazará y/o reparará según sea el caso, de forma gratuita y dentro de un plazo de tiempo establecido para este propósito, los materiales y defectos de fabricación mediante la reparación o sustitución del Producto. Tenga en cuenta que esta Garantía limitada solo es válida si sigue vigente y siempre que el Producto se utilice de acuerdo con la Guía del usuario y las recomendaciones de uso destacadas en la página web y/o incluidas en el paquete de su dispositivo, y en el presente documento. Esta Garantía limitada de ELLU se aplica solo al Comprador original del Producto que compró a un distribuidor autorizado o canal de ventas y que fue fabrica- do por o para ELLU y que puede identificarse mediante una marca comercial autorizada, nombre comercial o logotipo de “ELLU”. Sin limitar lo anterior, esta Garantía limitada del producto no se aplica a (a) productos o servicios que no sean productos ELLU; (b) productos que no sean ELLU, incluso si se incluyen o venden con un producto ELLU, incluido, entre otros, productos falsificados; (c) productos que, o ELLU cree razonablemente que son robados; o (d) software, incluso si están empaquetados o vendidos o integrados en el Producto. Esta Garantía limitada del producto no se aplica a productos o accesorios de terceros, incluidos, entre otros, los productos con los logotipos “Made for ELLU” o “Works with ELLU”. En cualquier caso, ELLU enviará un albarán de entrega preparado para recoger el nuevo “Producto ELLU” con su embalaje. Esto debe contener su nuevo “Producto ELLU” con todos sus accesorios, y todo el paquete debe enviarse a la dirección que ELLU designe para este propósito. Una vez completado el Servicio de Garantía Limitada y siguiendo las instrucciones de ELLU, recibirá a cambio el Nuevo Producto ELLU en la dirección de compra que figura en la orden de compra original. Los gastos de envío y manipulación no se aplicarán. Esta Garantía limitada del producto es válida solo en las jurisdicciones donde ELLU vende los Productos. Debe entregar el Producto ELLU, en su embalaje original o en un embalaje que proporcione el mismo grado de protección, a la dirección especificada por ELLU. Según lo exija la ley aplicable, ELLU le exige que presente evidencia de compra y / o cumpla con otros requisitos antes de recibir el servicio de garantía. Es su responsabilidad hacer una copia de seguridad de cualquier dato, software u otro material que pueda tener almacenado o conservado en el Producto ELLU.
