Due to we found recently that our submitted information was used by other applicant without our authorization. This is absolutely illegal. So, we would like to request confidentiality on some exhibits we submitted for above original application for the reason for trade secret. If those exhibits are available for public inspection, any person who once gets the information contained in those exhibits will be able to design and to make the same products very easily. This is a very serious problem and huge loss for us, because we did invest so much on it. Please check my explanation below: Question #1: There are two rule parts may be applicable for this device which is opearating in 169 - 172MHZ band. Either Part 74 or Part 90. This device does not have , so Part 74 does not apply to this product. This device should comply with Part 90.265(b) which is designated to Wireless Microphone under Private Land Mobile Services. In the test report, all technical limits are reference to Part 74 requirements, please make necessary corrections and provided revised Test Report. ANS.: I am very sorry for the omission. This test report was created from a test report according to Part 74, so there are some descriptions that are not revised perfectly. However, we did perform the test according to Part 90, although these two sections are same on the test. Attached please find the corrected test report. By the way, as I knew and also I had the experience, Part 74 Subpart H is special for Low Power Auxiliary Station. The definition for Low Power Auxiliary Station is decribed on section 74.801 and there is no any requirement of the capabilities in connecting to broadcast station. A wireless MIC will be allowed to appy for Part 74 provided the operational frequency is within the specified band. This was my experience with FCC application. Question #2: Emission Designator indicated on the page 1 of test report is 34KF3E as well as in the operational description. However, the emission designator indicated on the application form is 54KF3E. Please explain and justify the emission designator by using Carson Rules. ANS.: Sorry for our omission. The 34kF3E is the Emission Designator of the original Part 74 report. The correct Emission Designator for this wireless MIC is 54kF3E. The applicable rule is 2M+2D= 2*15(kHz)+2*12(kHz)=54kF3E. If you have any further questions, please infrom me as soon as possible. And would you grant our other three application OBDAM80000612 / AN01T1434, OBDT20H0621 / AN01T1433, and M4Y-XI-300/ AN01T1497 with top priority? I have sent required explanations for two times.
