CONFIDENTIALITY REQUEST Date: _ Mar 29, 2010 __ Subject: Confidentiality Request for FCC ID: X3VNT800MFRM3V2 Pursuant to Sections 0.457 and 0.459 of the Federal Communications Commission’s Rules, the Applicant hereby requests permanent confidential treatment of information accompanying this Application as outlined below: 1) Block diagram 2) Schematics 3) Parts list 4) Operational description 5) User manual* 6) Internal photos* 7) Confidentiality request appendix (NDA template) *Note 1: The user’s manual is very technical and is not provided to the consumer because the consumer cannot service the device. Only the designated technicians will be responsible to install the device and that the manual will not be shown to the public. *Note 2: The product is a non-consumer device which is inaccessible to the general public and only serviceable by the licensee or his designated technicians. The product is the radio module of a CDMA BTS for the Carrier Networks, so it is not accessible to the public. It can be installed in an Indoor BTS or an Outdoor BTS. For the Indoor BTS, the building where the BTS is located will not be open to the public; for the Outdoor BTS, the BTS itself will be located at a restricted access area, and also, the BTS has an enclosure in which the product will be locked, so the product will be inaccessible to the general public at all. *Note 3: To support the confidentiality request, two appendixes are provided in a separate document. Both documents would be executed by signing officers of Ericsson and the customers. • Appendix A: Template Master Purchase Agreement Confidentiality Clause. This one is the confidentiality language from the template product sale agreement. Product documentation including but not limited to user/installation manuals would be marked as confidential and would be subject to the protections of the clause. • Appendix B: Template NDA (Non-Disclosure Agreement). This one is a standard NDA template that Ericsson would use with customers during the pre-sale period and with any other parties to whom we disclose confidential information including but not limited to product documentation.
