MUTUAL NON-DISCLOSURE AGREEMENT This Mutual Non-Disclosure Agreement (the “Agreement”) is entered into as of the ___ day of ______ 2026 and is made effective as of the date hereof between Amplitech Group Inc. Disclosure of Confidential Information The Recipient may disclose Confidential Information received by it under this Agreement only to its affiliates and its and their respective equity holders, investors, partners, directors, officers, employees, advisors, attorneys, accountants, financial advisors, agents, potential sources of debt and/or equity financing, or independent contractors or consultants working for or retained by Recipient, who have a “need to know” such Confidential Information in the course of the performance of their duties in connection with this Agreement and the purpose for which it was disclosed, and who are informed of the confidentiality obligations required by this Agreement (collectively, the “Authorized Users”). The Recipient shall be directly liable for the compliance of such Authorized Users. Notwithstanding the foregoing, the Recipient and its Authorized Users shall hold the Confidential Information in confidence, subject to the terms of this Agreement, and in a manner consistent with Recipient’s treatment of its own similar Confidential Information, but in no event shall Recipient and its Authorized Users treat such information with less than reasonable care and diligence. In addition, Recipient shall not, at any time, directly or indirectly, sell, transfer, publish, divulge, display, reveal, or communicate any Confidential Information to any Person whatsoever (other than Authorized Users or as otherwise authorized under this Agreement), or use, pursue, or exploit any Confidential Information or any derivation thereof, for its or their own benefit or for the benefit of others, without obtaining the prior written consent of the Disclosing Party in each instance, which consent may be granted, condition, or withheld in the sole and absolute discretion of the Disclosing Party. The Recipient and its Authorized Users shall use such Confidential Information only for the Purpose for which it was disclosed, and for no other purpose. The Native DAS product (FCC ID: 2BNMP-PRRU880X, IC: 34498-PRRU880X) supports the following frequency bands: • LTE bands B25 and B66 • NR band N7 • NR band N77 The regulatory applicability of these bands is as follows: • Bands B25, B66, and N7 are intended for operation in both the United States and Canada and have therefore been evaluated against FCC and ISED requirements. • NR band N77 (3450–3900 MHz) is intended exclusively for operation in Canada and has been evaluated only to ISED requirements. Although the device hardware is capable of supporting NR band N77, operation of this band is restricted by software configuration for the United States market. The device will not transmit or operate in NR band n77 when configured for FCC/US use, and it is not intended to be marketed or operated in the United States with n77 functionality enabled under the current certification scope. As a result, FCC requirements for NR band n77 do not apply to this submission. The NR supports 5, 10, and 15 MHz channel bandwidth in Band n25, 10, 20, and 30 MHz channel bandwidth in Band n66, and 10, 15 and 20 MHz channel bandwidth in Band n7. The LTE supports 5, and 20 MHz channel bandwidth in BandB25, 15 MHz channel bandwidth in Band B66, and 10, 15, and 20 MHz channel bandwidth in Band B7.
