(GARMIN) manufactures aeronautical VHF transceivers which are installed in aircraft worldwide. GARMIN is preparing an application for Certification of an aeronautical VHF transceiver (FCC Identification Number IPH- 0061100). This transceiver has been designed to comply with the new ICAO requirements to transmit and receive on channels that are spaced at 8.33 kHz intervals. The pilot may adjust the channel spacing to either 8.33 kHz or 25 kHz to comply with the local requirements of the area in which he is operating. The FCC Equipment Authorization Division has indicated that a waiver of Section 87.173 of the Commission’s rules and regulations is necessary to allow Certification of aeronautical VHF transceivers that are capable of 8.33 kHz channel spacing. GARMIN respectfully requests a rule waiver to deviate from the 25 kHz channel spacing requirements in 47 CFR 87.173 to allow FCC Certification of our transmitter which utilizes the frequency range as follows: 118.000 MHz - 136.975 MHz in 25 kHz steps or 118.000 MHz - 136.990 MHz in 8.33 kHz steps. Precedence for a rule waiver in this circumstance has been established by other radio manufacturers and GARMIN that have requested and received from the Commission a rule waiver regarding 8.33 kHz channel spacing used in VHF aeronautical transceivers. (reference FCC Order DA 98-275 dated February 11, 1998 and FCC Order DA 98-1176 dated October 6, 1998) The 8.33 kHz channel spacing standard was recommended by the International Civil Aviation Organization (ICAO) in 1995 to address increasing shortages of air traffic control VHF radio frequencies around the world, particularly in western Europe. At least eight western European states are scheduled to implement the 8.33 kHz channel spacing on October 7, 1999. GARMIN believes that Commission approval of a waiver to allow Certification with 8.33 kHz channel spacing is consistent with U.S. international commitments to ensure air safety by providing for efficient VHF communications during flights between the United States and Europe and is therefore in the public interest. It is neither efficient, cost effective, nor necessarily safe to require aircraft operating in both U.S. and European airspace to carry two VHF transceivers; one with Commission certification that can utilize only the frequencies listed in 87.173 and another capable of 8.33 kHz channel spacing but without Commission Certification. U.S. industry and the FAA have recognized that U.S. registered aircraft will need to operate in European airspace and that European registered aircraft will need to operate in U.S. airspace. RTCA, Inc. and ARINC have approved U.S. VHF transceiver standards including the 8.33 kHz channel spacing capability based on the ICAO recommendation. The FAA has recognized these recommendations by approving FAA certification and installation of FCC Type Accepted VHF transceivers with 8.33 kHz channel spacing on Type Certificated aircraft. The attenuation specification is not XX uV/M, or derived from absolute value of the field strength. The dBc is determined from the substitution method such as described in the ANSI/TIA/EIA-603-1992 document. What is needed is a determination of the actual power levels necessary to reproduce these field strength levels. Those power levels (from a signal generator source and a dipole antenna replacing the EUT) are then compared to the power output of the transmitter to determine dBc. There is no difference to make this radio a narrow band device. It functions in the same manner as an earlier version of this aviation transceiver (FCC ID number IPH-0021400). 2.) The spurious emissions at the antenna terminal were tested with the unit modulated as required by section 2.1049. 3.) The radiated spurious emissions have been retested and results are included in the revised test report (file name GNS430A.pdf) which has been uploaded to the FCC web site. 4.) The type error on page 15 of the report has been corrected. 5.) The FAA does not return a letter to the manufacturer unless they have a concern about the equipment. The letter informing the FAA about the transceiver (file named gns430a_faa_fcc.pdf) has been uploaded to the FCC web site for your review. Please proceed with the grant of certification procedure. INTRODUCTION 1. Under consideration is a request for waiver filed by GARMIN International, Inc. (Garmin) on December 4, 2001. 1 Garmin seeks waiver of Section 87.173(b) of the Commission's Rules 2 to permit type certification of VHF aircraft transceiver capable of transmitting on both the 25 kHz spaced channels currently authorized pursuant to Section 87.173(b) of the Commission's Rules and on the 8.33 kHz spaced channels that are used in certain countries in Europe and in the United Kingdom. Such transceivers are known as dual spacing transceivers. For the reasons discussed herein, we grant the requested waiver regarding operation of the Rockwell Collins transceivers with 25 kHz and 8.33 kHz channel spacing, subject to the Commission’s decision regarding a pending Notice of Proposed Rule Making that proposes to amend our rules to permit the type certification of dual spacing transceivers. We note, however, that this Order does not authorize aircraft to transmit on 8.33 kHz spaced channels within airspace of the United States, its territories or the Commonwealth of Puerto Rico, but is limited to permitting type certification of specified transceivers capable of transmitting on both 25 kHz spaced channels in the United States and on the 8.33 kHz spaced Aeronautical Mobile Service (AMS) channels used in certain other countries. II. BACKGROUND 2. In March of 1997, the International Civil Aviation Organization (ICAO), an international body operating under the auspices of the United Nations, amended its International Standards and Recommended Practices to incorporate a channel plan specifying 8.33 kHz channel spacings in the AMS. 3 The 8.33 kHz 1 Letter to Federal Communications Commission, from Van Ruggles, Director, Quality Assurance, GARMIN International, Inc., dated December 4, 2001. Federal Communications Commission DA 02-379 2 channel plan was adopted to alleviate the shortage of VHF Air Traffic Control (ATC) channels experienced in western Europe and in the United Kingdom. 4 Seven western European countries and the United Kingdom implemented the 8.33 kHz channel plan in 1999. 5 Accordingly, aircraft operating in the airspace of these countries must have the capability of transmitting and receiving on the 8.33 kHz spaced channels. 3. Section 87.39 of the Commission's Rules requires that (1) U.S.-registered aircraft employ type certified radios; and (2) aircraft radios must meet the technical requirements of Subpart D of Part 87 of the Commission's Rules in order to be type certified under the Commission’s Rules. 6 Subpart D of Part 87 contains a list of "assignable carrier frequencies or frequency bands" and includes carrier frequencies in the VHF aircraft band used for ATC communications (namely, 117.975 MHz to 136.975 MHz). 7 The listed frequencies are based on 25 kHz spacing. There is no provision in the Commission's Rules for operating on 8.33 kHz spaced channels as envisioned by the ICAO channel plan. Accordingly, type certification of dual spacing transceivers may not be obtained absent a waiver of Section 87.173(b) of the Commission’s Rules. However, the Commission has released a Notice of Proposed Rule Making to review the Aviation Radio Service rules and seeks comment on whether to permit the certification of dual spacing transceivers for aircraft also operating in countries which employ 8.33 kHz channel spacing. 8 III. DISCUSSION 4. Section 1.925 of the Commission's Rules provides that we may grant a waiver if it is shown that (a) the underlying purpose of the rule(s) would not be served or would be frustrated by application to the instant case, and grant of the requested waiver would be in the public interest; or (b) in light of unique or unusual circumstances, application of the rule(s) would be inequitable, unduly burdensome, or contrary to the public interest, or the applicant has no reasonable alternative. 9 We find that the waiver requested by Garmin is warranted under the circumstances presented. Specifically, we conclude that the underlying purpose of the subject rules would not be served by application to the instant case and grant of the requested waiver would be in the public interest. T Page 3 1. GENERAL The alignment procedures are intended to be performed after board assembly . The alignment procedures are also used after replacing a component or module causing misalignment. The alignment procedures should be followed in the sequence presented. Certain sections of the radio must be aligned using subsections of the alignment procedure before the whole board can be aligned. This alignment procedure is written for a complete realignment. If only a subsection is required, use only the initial settings required as outlined in the procedure for the subsection. The comm board must be placed into a main chassis before alignment.
