IMPORTANT SAFETY AND PRODUCT INFORMATION WARNING Failure to heed the following warnings could result in an accident or collision resulting in death or serious injury. Usage Requirements • Messaging, tracking, and SOS functions require an active satellite subscription. Always test your device before you use it outdoors. • Ensure that you have a clear view of the sky when using the messaging, tracking, and SOS functions of the device, as these features require satellite access to operate properly. Distraction Warning This device is intended to enhance the situational awareness when used properly. If used improperly, you could become distracted by the display, which could lead to an accident causing serious personal injury or death. Only access the information displayed on the device with a glance. Always maintain awareness of your surroundings and do not stare at the display or become distracted by the display. Focusing on the display could prevent you from avoiding obstacles or hazards. Battery Warnings A replaceable lithium-ion battery pack is used with the dog collar device and handheld device. If these guidelines are not followed, batteries may experience a shortened life span or may present a risk of damage to the device, fire, chemical burn, electrolyte leak, and/or injury. • Do not disassemble, modify, remanufacture, puncture or damage the device or batteries. • Do not expose the device or batteries to fire, explosion, or other hazard. • Do not use a sharp object to remove the removable batteries. • KEEP BATTERIES AWAY FROM CHILDREN. NEVER PUT BATTERIES IN MOUTH. Swallowing can lead to chemical burns, perforation of soft tissue, and death. Severe burns can occur within 2 hours of ingestion. Seek medical attention immediately. • If using an external battery charger, only use the Garmin ® accessory approved for your product. • Only replace batteries with correct replacement batteries. Using other batteries presents a risk of fire or explosion. To prevent the possibility of damage, remove the device from the vehicle or store it out of direct sunlight, such as in the glove box. • Do not operate the device outside of the temperature ranges specified in the printed manual in the product packaging. • When storing the device for an extended time period, store within the temperature ranges specified in the printed manual in the product packaging. • Do not use a power cable, data cable and/or power adapter that is not approved or supplied by Garmin. Off-Road Navigation Warnings If your Garmin device is able to suggest off-road routes for various outdoor activities, such as biking, hiking, and all-terrain 1 vehicles, follow these guidelines to ensure safe off-road navigation. • Always use your best judgment and exercise common sense when making off-road navigational decisions. The Garmin device is designed to provide route suggestions only. It is not a replacement for attentiveness and proper preparation for outdoor activities. Do not follow the route suggestions if they suggest an illegal course or would put you in an unsafe situation. • Always carefully compare information displayed on the device to all available navigation sources, including trail signs, trail conditions, weather conditions, and other factors that may affect safety while navigating. For safety, always resolve any discrepancies before continuing navigation, and defer to posted signs and conditions. • Always be mindful of the effects of the environment and the inherent risks of the activity before embarking on off-road activities, especially the impact that weather and weather- related trail conditions can have on the safety of your activity. Ensure that you have the proper gear and supplies for your activity before navigating along unfamiliar paths and trails. Vehicle Installation Warnings • When installing the device in a vehicle, do not place the device where it obstructs the driver’s view of the road or interferes with vehicle operating controls, such as the steering wheel, foot pedals, or transmission levers. Do not place unsecured on the vehicle dashboard . Do not place the device in front of or above any airbag . Street Navigation Warnings If your Garmin device accepts street maps and suggests routes that follow roads, follow these guidelines to ensure safe on-road navigation. • Always use your best judgment, and operate the vehicle in a safe manner. Do not become distracted by the device while driving, and always be fully aware of all driving conditions. Minimize the amount of time spent viewing the device screen while driving. • Do not input destinations, change settings, or access any functions requiring prolonged use of the device controls while driving. Pull over in a safe and legal manner before attempting such operations. • When navigating, carefully compare information displayed on the device to all available navigation sources, including road signs, road closures, road conditions, traffic congestion, weather conditions, and other factors that may affect safety while driving. Introduction. This Order addresses a request filed by Garmin International, Inc. (Garmin) for Declaratory Ruling, or in the alternative, Waiver of section 95.2761(c) of the Commission’s Rules. 1 Garmin seeks relief from section 95.2761(c) in order to obtain authorization for a hand-held device that will combine a low-power, terrestrial Multi-Use Radio Service (MURS) 2 transmitter and an emergency satellite communications module in the same unit. 3 Section 95.2761(c) provides that “[a] grant of equipment certification will not be issued for MURS transmitters capable of operating under both this subpart (MURS) and under any other subparts of this chapter (except part 15).” 4 For the reasons stated below, we deny Garmin’s request for a declaratory ruling, but find that it is in the public interest to grant Garmin’s waiver request, subject to the conditions outlined in this Order. 2. Background. Federal Communications CommissionDA 20-1071 2 license held by Iridium, provided the end user subscribes to the Iridium service. 7 On April 24, 2020, Garmin requested that the Commission issue a declaratory ruling that section 95.2761(c) does not apply to its proposed, dual capacity handheld device, or in the alternative, that the Commission waive section 95.2761(c) of its Rules so that Garmin may obtain equipment certification for its device, despite its dual transmitting capability and the fact that it combines a licensed-by-rule service, i.e., MURS with a licensed satellite service. 3. Discussion. The purpose of a declaratory ruling is to terminate a controversy or remove uncertainty, and no such controversy or uncertainty exists here. 8 Garmin argues that section 95.2761(c) “is inapposite to its proposed product” because “it is not meant to prohibit combining into a single unit a certified part 25 module used for emergency satellite communications and a MURS transmitter.” 9 We disagree. As an initial matter, section 95.2761(c) governs Garmin’s proposed device. The provision is clear on its face and does not provide an exception for part 25 modules that do not require separate licensing. 10 It precludes the combination of transmitting equipment, i.e., MURS end products capable of operating under other licensed or licensed-by-rule radio services. The rule states that “[a] grant of equipment certification will not be issued for MURS transmitters capable of operating under both this subpart (MURS) and under any other subparts of this chapter (except part 15).” 11 Garmin’s proposed handheld device possesses the kind of dual capability broadly proscribed by section 95.2761(c). As such, we find that it would not be appropriate to issue a declaratory judgment exempting the device entirely, and we deny Garmin’s request for declaratory relief. 4. We find, however, that it is in the public interest to waive section 95.2761(c) so that Garmin may nevertheless obtain authorization to produce its proposed combination handheld device. Section 1.925 of the Commission's rules provides that we may grant a waiver if it is shown that: (a) the underlying purpose of the rule(s) would not be served or would be frustrated by application to the instant case, and grant of the requested waiver would be in the public interest; or (b) in light of unique or unusual circumstances, application of the rule(s) would be inequitable, unduly burdensome, or contrary to the public interest, or the applicant has no reasonable alternative. 12 5. We find here that Garmin’s proposed device contains an important public safety feature, which would not be brought to market if we were to strictly enforce the rule in this case. “The certified Part 25 module in the MURS unit would allow emergency communications to the outside world at the push of a button.” 13 Second, while Garmin’s device, in fact, combines MURS capability with satellite communications capability, therefore triggering section 95.2761(c), we do not expect it to produce the harm the rule was …
