July 14, 2006 RE: FCC ID: OPH-EV3000_ATCB003738 Attention: Richard McMurray / Kathy Grzovic I have a few comments on this Application. Please note that further comments may arise in response to answers provided to the questions below. 1. Please note that the application states part 90 which is a licensed device rule part. Page 5 of the report states use of ANSI C63.4 as a tes method. Please note that TIA603 is the appropriate test method for licensed devices an dANSI C63.4 has no relevance except for setup. Please explain and please provide references to proper test methods and use. 2. Please note that you reference TIA603 2002. Please note that the proper FCC test method to use is in TIA603-C 2004. Please explain the use of an older version of TIA603. Please correlate your data to the most current accepted method by FCC. 3. Please note that the plot shown on page 17 of the report appears to show failure of the mask selected. Please retest and provide data showing clear compliance to the emissions mask. 4. Please note that page 22 of the report states that the device does not have audio low pass filtering. Please note that the emissions mask B selected for this device as shown in the report is specifically for devices containing audio low pass filters (i.e. “Emission Mask B. For transmitters that are equipped with an audio low-pass filter, the power of any emission must be attenuated below the unmodulated carrier power (P) as follows...”). Please explain the use of mask B. Dennis Ward mailto:[email protected] The items indicated above must be submitted before processing can continue on the above referenced application. Failure to provide the requested information may result in application termination. Correspondence should be considered part of the permanent submission and may be viewed from the Internet after a Grant of Equipment Authorization is issued. Please do not respond to this correspondence using the email reply button. In order for your response to be processed expeditiously, you must submit your documents through the AmericanTCB.com website. Also, please note that partial responses increase processing time and should not be submitted. Any questions about the content of this correspondence should be directed to the sender.

For transmitters that are equipped with an audio low-pass filter, the power of any emission must be attenuated below the unmodulated carrier power (P) as follows...”) Please explain the use of Mask B. Response: Part 90.210 does not have a specific mask for equipment operating in the 2458 – 2474 MHz frequency range. Mask B and C are specified for “all other bands”, for equipment with an audio low pass filter and for equipment without an audio low pass filter, respectively. While the equipment in this application does not have an audio low pass filter, Mask C is not appropriate as it does not allow for equipment with the designated bandwidth in this application. Therefore, compliance is shown with Mask B. Dennis Ward mailto:[email protected] The items indicated above must be submitted before processing can continue on the above referenced application.
