Lawrenceburg, OH 47025 Re: Repeater or Other Radio Frequency Enhancer Located at 600 Wilson Creek Rd., Lawrenceburg, IN 47025 Dear Mr. Dillard, AT&T Mobility National Accounts LLC and its affiliates (collectively, “AT&T”) must ensure that the integrity of the AT&T network is maintained so that AT&T can provide you and other subscribers with quality service and avoid harmful interference to other FCC licensees. Moreover, the FCC requires AT&T to maintain operational control over any transmitting device deployed within AT&T’s network, whether such device is using AT&T’s assigned frequencies or the frequencies on which other carriers operate. Repeaters, bi-directional amplifiers and similar radio frequency enhancements (each, a “device”) deployed on your premises may negatively impact AT&T’s network or the networks of other carriers or FCC licensees. In order to comply with this FCC requirement, AT&T must control the devices utilized on its network and must be able to access any devices operating on AT&T’s spectrum or within AT&T’s network on a twenty-four (24) hours per day, seven (7) days per week basis in order to ensure that the devices are not interfering with AT&T’s network or the networks of other carriers or FCC licensees. Accordingly, any entity that installs a device within AT&T’s network that transmits AT&T’s frequencies must first obtain AT&T’s consent to deploy such device and must provide AT&T with twenty- four (24) hour a day, seven (7) day a week access to, and contact information for, any such device. AT&T will, of course, work with our customers by providing appropriate notice when access is needed. Notwithstanding the foregoing, in order to prevent harmful interference, AT&T retains the right to shut down, without advance notice, any device operated within AT&T’s network that causes harmful interference to AT&T’s own network, customers or users, or any other licensee’s network, customers or users. There may be other federal, state or local legal requirements and guidelines with which you have to comply in order to install or deploy such devices. As these become applicable, we will attempt to advise you of their impact. In order for you and AT&T to comply with the foregoing, any device and related electronics, antennas, cabling and other equipment installed on your premises (collectively, the “System”) must meet the requirements set forth below. You are authorized to deploy a System only if you comply with the following requirements: (a) The device used in the System must be approved by AT&T. Please consult with your AT&T In-building Solutions Consultant to obtain a list of approved devices and vendors. (b) The System may only be installed by an AT&T-approved contractor. Please consult with your AT&T In-Building Solutions Consultant to obtain a list of approved contractors. (c) You cannot install the System without AT&T’s prior approval of the component equipment and system design. AT&T has absolute discretion to determine whether to approve the installation of any System. Thus, the system design (detailing the device and any associated signal distribution system and other equipment) must be presented to AT&T through your AT&T project manager for approval. AT&T reserves the right to reject any system design without qualification. Permission to activate the System as designed is contingent upon such specific written approval from AT&T and shall not occur otherwise. (d) You are responsible for any costs associated with the initial device qualification process, the approval of the System, and the installation and maintenance of the System. (e) You may need to make modifications to your System in the future in order to maintain satisfactory performance, due to changes made by AT&T on its network or due to harmful interference being caused to AT&T’s network or the network of any other FCC licensee, and any such modifications will be at your sole expense. In addition to complying with the foregoing requirements, you must provide AT&T with the information set forth below and immediately notify AT&T in writing if any of the information changes. • The specific location of the System, including the street address and description in building. • The anticipated number of users. • The effective “on-air” date/installation date. • Upon installation of the System, a copy of the “as built” information. • The name(s) and phone number(s) of the person(s) who can be contacted by AT&T or its subcontractors twenty-four (24) hours per day, seven (7) days per week to provide prompt access to the System as needed, twenty-four (24) hour per day, seven (7) days per week.
