Operational Instructions and Training Guidelines To ensure optimal performance and compliance with the occupational/controlled environment RF energy exposure limits in the above standards and guidelines, users should transmit no more than 50% of the time and always adhere to the following procedures: Transmit and Receive To transmit (talk), push the Push-To-Talk (PTT) button; to receive, release the PTT button. Hand-held radio operation Hold the radio in a vertical position with the microphone one to two inches (2.5 to 5 cm) away from the lips. FCC Compliance This equipment has been tested and found to comply with the limits for a Class B digital device, pursuant to part 90 of the FCC Rules. These limits are designed to provide reasonable protection against harmful interference in a residential installation. This equipment generates, uses and can radiate radio frequency energy and, if not installed and used in accordance with the instructions, may cause harmful interference to radio communications. However, there is no guarantee that interference will not occur in a particular installation. If this equipment does cause harmful interference to radio or television reception, which can be determined by turning the equipment off and on, the user is encouraged to try to correct the interference by one or more of the following measures: · Reorient or relocate the receiving antenna. · Increase the separation between the equipment and receiver. · Connect the equipment into an outlet on a circuit different from that to which the receiver is connected. · Consult the dealer or an experienced radio/TV technician for help. FCC Requirements Your radio must be properly licensed Federal Communications Commission prior to use. Your dealer can assist you in meeting these requirements. Your dealer will program each radio with your authorized frequencies, signaling codes, etc., and will be there to meet your communications needs as your system expands. Safety: It is important that the operator is aware of and understands hazards common to the operation of any radio. READ THIS IMPORTANT INFORMATION ON SAFE AND EFFICIENT OPERATION BEFORE USING YOUR HYT PORTABLE TWO-WAY RADIO. ◇ Only qualified technicians are allowed to maintain this product. ◇ To avoid electromagnetic interference and/or compatibility conflicts, turn off your radio in any place where posted notices instruct you to do so. Hospitals or health care facilities may be using equipment that is sensitive to external RF energy. When on aircraft, turn off your radio when airline crew instruct you to do so. ◇ When in vehicles with an airbag, do not place a portable radio in the area over an airbag or in the airbag deployment area. ◇ Turn off your radio prior to entering any area with a potentially explosive atmosphere. Do not remove, install, or charge batteries in such areas. ◇ To avoid possible interference with blasting operations, turn off your radio when you are near electrical blasting caps. ◇ Do not use any portable radio that has a damaged antenna. If a damaged antenna comes into contact with your skin, a minor burn may result. ◇ Do not expose the radio in direct sunlight for a long time nor place it close to a heating source. ◇ When transmitting with a portable radio, hold the radio in a vertical position with its microphone about 5 centimeters away from your mouth. ◇ If you wear a portable two-way radio on your body, ensure that the antenna is at least 2.5 centimeters from your body when transmitting.

Holzberg Communication September 19, 2007 Equipment Authorization Division Office of Engineering and Technology Federal Communications Commission Industrial Canada Certificate Bureau Ref: FCC ID: Q9FPX-328U Label Justification Dear Sirs: The applicant requests acceptance of the labeling proposal described below for transmitters bearing FCC identifier Q9FPX-928U. The subject transmitters are handheld marine radio lower power radio models as shown in figure 1. Because the majority of the transmitters housing is composed of touching area, LCD display, and a removable battery pack, there is extremely limited space available to attach the required label carrying the FCC identifier. Attaching the label to the battery pack is not acceptable because the battery pack is a removable item. For this reason, we proposes placing the label carrying the FCC identifier inside the battery compartment as shown in figure 2. The consumer packaging for these models includes the battery pack as a separate item, NOT installed on the radio. As such, the FCC identifier will be readily visible to the user before the battery pack is installed and whenever the battery pack is removed or replaced. In this location, the label will also be protected from physical abuse and remain readable for the anticipated life of the device. The consumer packaging for these models is a "carbon box" which does not allow the transmitters to be seen at time of purchase. In order to meet the requirements of 47CFR Part 2.925 (d), we will add the FCC identifier "Q9FPX-328U to the outside of the consumer "carbon box" packaging. Sincerely, Andy Holzberg

Applicant: Holzberg Communications, Inc. FCC ID: Q9FPX-328U Form 731 Confirmation Number: EA518686 Date of Original E-Mail: 11/08/2007 Correspondence Reference Number: 34223 November 16, 2007 Dear FCC, 1) The cover letter indicates that this is a maritime radio. The User's Manual references maritime DSC. You applied for Part 90. Is this a Part 80 device? Please explain. The unit is a Part 90 radio. The “marine radio” in Label Location Justification cover letter was a typo from a letter template. A correct cover letter is submitted with the response. The manufacturer replied that user’s manual only indicates DCS (Digital Coded Squelch). Please advise if there is other DSC in the User’s Manual. 2) Operations under Occupational SAR limits and a 50% operating duty factor are assumed for most Part 90 push-to-talk (PTT) mode devices. As part of the 47 CF R 2.1033(c)(3) required operating instructions, RF exposure training instructions and labeling information must be submitted to satisfy the criteria to qualify for occupational operations shown in 2.1093, i.e., "work-related" and "aware of and exercise control over exposure" criteria. Please submit RF exposure labeling info for this device. The manufacturer updated user’s manual with RF exposure info. The info is included in the last page of new user’s manual. The page of containing RF Exposure info was submitted to your review. Alternatively, SAR data showing compliance with general population SAR limits may be submitted to obviate the need for occupational training and labeling. 3) per 2.1033(c)(12), please submit internal photos showing chassis assembly, ie exploded view of housing and circuit board and other components showing how all fit together An exploded view of housing and circuit board and other components showing how all fit together was submitted. 4) user manual says belt-clip is supplied with unit - please provide photos or engineering drawings of belt-clip, and including length/width/depth dimension info A photo of belt clip and its dimension was submitted. Please contact us if you have further questions. Yours truly, Timco Engineering Inc.
