This document is an agreement (“Agreement”) between the end user (“You”) and Enterasys Networks, Inc. on behalf of itself and its Affiliates (as hereinafter defined) (“Enterasys”) that sets forth Your rights and obligations with respect to the Enterasys software program/firmware installed on the Enterasys product (including any accompanying documentation, hardware or media) (“Program”) in the package and prevails over any additional, conflicting or inconsistent terms and conditions appearing on any purchase order or other document submitted by You. “Affiliate” means any person, partnership, corporation, limited liability company, or other form of enterprise that directly or indirectly through one or more intermediaries, controls, or is controlled by, or is under common control with the party specified. You and Enterasys agree as follows: 1.LICENSE.You have the non-exclusive and non-transferable right to use only the one (1) copy of the Program provided in this package subject to the terms and conditions of this Agreement. 2.RESTRICTIONS.Except as otherwise authorized in writing by Enterasys, You may not, nor may You permit any third party to: (i)Reverse engineer, decompile, disassemble or modify the Program, in whole or in part, including for reasons of error correction or interoperability, except to the extent expressly permitted by applicable law and to the extent the parties shall not be permitted by that applicable law, such rights are expressly excluded. Information necessary to achieve interoperability or correct errors is available from Enterasys upon request and upon payment of Enterasys’ applicable fee. Notice iii (ii) Incorporate the Program, in whole or in part, in any other product or create derivative works based on the Program, in whole or in part. October 12, 2005 To Whom It May Concern: Please find he Enterasys Networks response to the following question raised by the TCB. • It seems this product need power adjustment by end user for different antenna usage. And according to present FCC policy this product will need professional installation to comply with rule requirement. Please confirm if this is a professional installed product? Enterasys Networks response: The RBT-4102 does require power adjustment based on the antenna selected for use. The end user does have the capability of selecting the antenna of choice but the power adjustment is NOT selectable by the end user. The output power is controlled by software based on homologation tables developed during EMI/EMC testing at approved laboratory (ADT). Output power is set based on the antenna selected and the power is adjusted based on the antenna gain to ensure that the output power meets the regulatory requirements for the frequency band of operation. In conclusion: End user does NOT have the ability to select output power and we already employ non-standard antenna connectors ( reverse polarity “N”). Based on the above Enterasys Networks does not believe that Professional Installation is required for this product. Enterasys Networks feels that we meet the FCC requirements as is. Data transmission is always initiated by software, which is then pass down through the MAC, through the digital and analog baseband, and finally to the RF chip. Several special packets (ACKs, CTS, PSPoll, etc...) are initiated by the MAC. There are the only ways the digital baseband portion will turn on the RF transmitter, which it then turns off at the end of the packet. Therefore, the transmitter will be on only while one of the aforementioned packets are being transmitted.
