OR LICENSED TO SOMA NETWORKS, INC., THE USE OF WHICH IS SUBJECT TO THIS AGREEMENT. BY: (A) SIGNING AN AGREEMENT FOR SERVICE WITH YOUR SERVICE PROVIDER; (B) OPENING THE SEALED ENVELOPE CONTAINING THE SOMAPORT; OR (C) USING THE SOMAPORT, YOU ASSENT TO AND ACCEPT THIS ENDUSER PRODUCT LICENSE AGREEMENT. GRANT OF LICENSE: Subject to the terms of this Enduser Product License Agreement (the "Agreement"), SOMA Networks, Inc. ("SOMA") grants you (the "Licensee") a non-sub-licensable, non-exclusive right ("License") to use the Product. "Product" means, collectively, the Software and the provided hardware, and specifically the SOMAport™ subscriber station and its accessories, if any, together with documentation provided to you by SOMA or your service provider. "Software" means, collectively, the version of the SOMA software program in object code format and all updates to that program distributed to you by SOMA, directly or indirectly, by any means and includes any firmware provided to you with the Product. You have no right, unless otherwise explicitly permitted, to receive any source code or design documentation relating to the Product. SOMA retains ownership of all Software copies. The Software and this License is only provided to you to be used in conjunction with the SOMAport provided to you by SOMA or your service provider when you subscribed to services that utilize the SOMA Air Interface™ wireless technology and is not licensed to you to be used for any other purpose. 2. RESTRICTIONS: Except as reasonably required to use the Product strictly in accordance with the License and this Agreement, you may not copy any Software. Licensee shall not (and shall not allow any third party to): (I) decompile, disassemble, or otherwise reverse engineer or attempt to reconstruct or discover any source code or underlying ideas or algorithms or file formats or programming or interoperability interfaces of the Product by any means whatsoever; (II) remove any Product identification, copyright or other notices; (III) modify, incorporate into or with other software or create a derivative work of any part of the Software or Product; or (IV) modify or otherwise alter the operation of the Product. Various components, functions, routines and/or portions of the Product may be protected by Intellectual Property Rights ("IPR") including, but not limited to, designs, copyrights, trade secrets and one or more patents or pending patent applications. Licensee is licensed under such IPR, if any, only to the extent that such a license is required by the licensee to operate the Product in the manner intended by SOMA. No other rights are granted under such IPR and no right to repair or replace the Product is intended or provided and specifically, no right of reconstruction, substitution or repair is provided. 3. TERMINATION: This License is effective until terminated. This License will terminate automatically if you fail to cure any material breach, as determined at the sole discretion of SOMA, of this Agreement within thirty (30) days after such breach first occurs (or immediately in the case of a breach of § 2). Upon termination, you shall immediately cease all use of the Product and return all of the Product including Software, hardware, manuals, documentation of any kind accompanying Product to the place where you first obtained such Product or such other location as may be designated from time to time. (“SOMA”) and submitted on its behalf of by Elliott Laboratories Inc. will not be disclosed or made routinely available to the public (the “Request”). The material being provided to the Commission in support of the Application contains both trade secrets and contains commercial information that is confidential and contains information such that any disclosure would result in substantial competitive harm. Elliott Laboratories, Inc., is a consulting and testing laboratory, and is filing a Form 731 Application as authorized under 47 C.F.R § 2.1033 with the Commission on our behalf. Included with the Application as exhibits to Application are block diagrams, schematics, and a detailed description of the theory of operation of the device that are the subject of the Request. In accordance with 47 C.F.R. § 0.459 (a) and (b) and in support of its Request, SOMA submits the following facts to be considered by the Commission. SOMA submits that the facts as presented shall enable the Commission to grant the Request that the material provided by SOMA in support of its Application shall neither be disclosed or made generally available to the public pursuant to 47 C.F.R. § 0.460 and § 0.461. As part of SOMA’s operations and compliance with the Commission’s governing statues and regulations, SOMA is submitting to the Commission pursuant to 47 C.F.R § 2.1033 an Application regarding certain SOMA technologies. Included therein are exhibits with the enclosed application are block diagrams, schematics, and a detailed description of the theory of operation of the device. Each of these block diagrams, schematics and detailed descriptions of the theory of operation of the devices and/components are Proprietary and Confidential. The material provided in the Application constitute trade secrets in that any competitor obtaining the material through a third-party such as the Commission would obtain a commercial advantage that they would not have had through their own research and development efforts. The materials provided in support of the Application describe the proprietary operation of SOMA’s products. These details are not readily discernable, even to technically sophisticated individuals. As such any disclosure of any of this material shall cause substantial competitive harm to SOMA. Any disclosure will remove the market lead that SOMA has developed in focusing its resources into research and development and now commercial exploitation of its research and development efforts. SOMA has taken great strengths to protect its intellectual property by maintaining strict rules and practices concerning the protection of confidential and proprietary information. Please note that the material provided to the Commission in support of the Application are trade secrets and that any disclosure of this material would be detrimental to SOMA. In the event that the Commission finds that it is unable to grant the Request, SOMA requests that pursuant 47 C.F.R § (e) that the materials be forwarded from the Commission to SOMA to the attention of the undersigned; and that in the event that the Commission decide to not grant the Request that it make a temporary supplemental order to maintain confidentiality for the period to file a review of the application with the Commission and during the Commission’s review period. III) Mobile Transmitters identified in §2.1091 Transmitters identified in §2.1091, unless categorically excluded, are required to demonstrate MPE compliance by routine evaluation. TCB may approve mobile devices that satisfy MPE Categorical Exclusion Requirements of §2.1091 provided the transmitter does not transmit simultaneously in multiple frequency bands. Categorically Exclution Statement In § 2.1091(b), a mobile device is defined as a transmitting device designed to be used in other than fixed locations and to generally be used in such a way that a separation distance of at least 20 centimeters is normally maintained between the transmitter's antenna and the body of the user or nearby persons. In accordance with § 2.1091(c), mobile PCS devices are categorically excluded from routine environmental evaluation for RF exposure prior to equipment authorization or use if their ERP is less than 3 W (34.77 dBm), if the device transmits above 1.5 GHz or 1.5 W (31.76 dBm) if the device transmits below 1.5 GHz. The SOMAport user manual mandates a separation distance of at least 20 cm between the unit's antenna and the body of the user and nearby persons for ALL uses and applications. The SOMAport is not designed for or intended to be used in portable applications, as defined in § 2.1093 (within 20 cm of the body of the user), and the user manual and OEM instructions contains specific language prohibiting such uses. Finally, to provide proof that the SOMAport is categorically excluded from a routine environmental evaluation for RF exposure, an MPE calculation is provided and has been uploaded, which is label “MPE calculation”. The maximum gain of the internal antenna is 3 dBi. The maximum power at the antenna terminal is 870.96 mW. The device will transmit above 1.5 GHz. Using the provided information the following EIRP or ERP can be calculated. 870.96 mW (29.4 dBm) EIRP = 29.4 dBm + 3 dBi = 32.4 dBm ERP = 32.4 dBm – 2.14 dB = 30.26 dBm or 1.06 Watts Using the provided antenna gain, the total power, in ERP, comes out to be 1.06 Watts. This is below the 3 Watts (ERP), which excludes the SOMAport from routine environmental evaluation for RF exposure. Warning Label Exclusion Statement According to Supplement C to OET Bulletin 65 (Edition 97-01), for MPE evaluation of mobile devices, when it is determined that the device cannot meet the applicable field strength or power density limits under normal operating conditions, operation and warning instructions and/or prominent “warning labels” may be used to caution users and nearby persons to maintain a specified distance from the transmitter and to limit their exposure durations and/or usage conditions to ensure compliance. The SOMAport is well below Section 1.1310 (Uncontrolled/Populated) limits (Please refer to the data provided) and does meet the applicable limits under normal operating conditions. With this, we request that the warning label be waived, since the SOMAport RF hazard levels are well below the MPE limit. But, an RF safety statement will be mention in the Users manual. User Manual RF Safety Statement: IMPORTANT! In order to comply with the FCC RF exposure requirements, the antenna must be installed such that a minimum distance of 20 cm away from all nearby persons is maintained.
