American Telecommunications Certification Body Inc. 6731 Whittier Ave, McLean, VA 22101 July 22, 2003 RE: NETGEAR, Inc. FCC ID: PY3WAG311 After a review of the submitted information, I have a few comments on the above referenced Application. 1) The conducted powerline photographs appears to show copper tape around the card brackets and the back of the PC. Please explain as the PC used for testing should be an unmodified off the shelf unit. Use of copper tape should not be used during final EMC testing in an off the shelf host device. 2) The power meter used for testing on page 44 of the test report utilizes a VBW = 5 MHz. The FCC has recently had concerns with power measurements using this type of meter on signals with a bandwidth > VBW. Please provide new power measurements using a signal substitution methods with a signal generator and Oscilloscope and also adjust the RF exposure information as necessary. 3) The RF exposure exhibit uses the incorrect power measurements for 5745 and 5805 MHz. Please correct. 4) The delta on page 60 appears to be (0.79 - -47.52) 48.31 dB and the average power measured on page 30 for the fundamental appears to be 100.1 dBuV/m. If this is correct, please adjust the Note (2) calculations on page 58 as appropriate. 5) One of the 10520 MHz measurements on page 78 is incorrectly marked as a restricted band. Please correct. 6) The plot on page 120 and 121 do not appear to measure to the higher emissions shown in the restricted bands. Please provide new plots that measure to the highest signal in the restricted band. 7) This device is not considered to be compliant with 15.407(d). This requires the device to contain an integral antenna. Note that connectors are only allowed if they are located behind a shield or other components so the end user does not have any access to the connector. 8) This device does not appear to be compliant with 15.407(d) which requires the device to contain an integral antenna. Note that connectors are only allowed if they are located behind a shield or other components so the end user does not have any access to this connector. 9) Page 3 of 77 in the users manual shows a 2.5 cm distance. Note that this device should be classified as a mobile device. Mobile devices are required to stipulate a 20 cm user to antenna distance. Please adjust the manual. 10) The users manual is missing the prohibition against co-location. Please update the users manual. 11) This device operates in the lower UNII band. However the users manual is missing the information required by 15.407(e) restricting its use to indoor use only. Please adjust the users manual. Timothy R. Operational Description

FCC ID: PY3WAG311 ADT No.920522H01 Technical Description The transmitter of the EUT is powered by host equipment. The antenna is Dipole Antenna with MCX connector. This device is a Netgear 802.11a/g Wireless PCI Adapter operates in both the 5GHz and 2.4GHz bands. For more detailed instruction, please take a look at the user’s manual. FCC 15.407(c) states : The device shall automatically discontinue transmission in case of either absence of information to transmit or operational failure. These provisions are not intended to preclude the transmission of control or signaling information or the use of repetitive codes used by certain digital technologies to complete frame or burst intervals. Applicants shall include in their application for equipment authorization a description of hoe this requirement is met. Data transmission is always initiated by software, which is then pass down through the MAC, through the digital and analog baseband, and finally to the RF chip. Several special packets (ACKs, CTS, PSPoll, etc...) are initiated by the MAC. There are the only ways the digital baseband portion will turn on the RF transmitter, which it then turns off at the end of the packet. Therefore, the transmitter will be on only while one of the aforementioned packets are being transmitted.

FCC ID: PY3WAG311 ADT No.: 920522H011 RF EXPOSURE REPORT REPORT NO.: RF920522H01 MODEL NO.: WAG311 ACCORDING: FCC Guidelines for Human Exposure IEEE C95.1 APPLICANT: NETGEAR, Inc. ADDRESS: 4500 Great America Parkway, Santa Clara, CA 95054 USA ISSUED BY: Advance Data Technology Corporation LAB LOCATION: 47 14th Lin, Chiapau Tsun, Linko, Taipei, Taiwan, R.O.C. Lab Code: 200376-0 FCC ID: PY3WAG311 ADT No.: 920522H012 RF Exposure Measurement 1. Introduction In this document, we try to prove the safety of radiation harmfulness to the human body for our product. The limit for Maximum Permissible Exposure (MPE) specified in FCC 1.1310 is followed. The Gain of the antenna used in this product is measured in a Fully Anechoic Chamber (FAC) calibrated for antenna measurement in ADT, and also the maximum total power input to the antenna is measured. Through the Friis transmission formula and the maximum gain of the antenna, we can calculate the distance, away from the product, where the limit of MPE is reached. Although the Friis transmission formula is a far field assumption, the calculated result of that is an over-prediction for near field power density. We will take that as the worst case to specify the safety range. 2. RF Exposure Limit According to FCC 1.1310: The criteria listed in the following table shall be used to evaluate the environmental impact of human exposure to radio-frequency (RF) radiation as specified in 1.1307(b) LIMITS FOR MAXIMUM PERMISSIBLE EXPOSURE (MPE) Frequency Range (MHz) Electric Field Strength (V/m) Magnetic Field Strength (A/m) Power Density (mW/cm 2 ) Average Time (minutes) (A)Limits For Occupational / Control Exposures 300-1500......F/3006 1500-100,000......56 (B)Limits For General Population / Uncontrolled Exposure 300-1500......F/15006 1500-100,000......1.030 F = Frequency in MHz FCC ID: PY3WAG311 ADT No.: 920522H013 3. Friis Formula Friis transmission formula : Pd = (Pout*G) / (4*pi*r 2 ) where Pd = power density in mW/cm 2 Pout = output power to antenna in mW G = gain of antenna in linear scale Pi = 3.1416 R = distance between observation point and center of the radiator in cm Pd is the limit of MPE, 1 mW/cm 2 . If we know the maximum Gain of the antenna and the total power input to the antenna, through the calculation, we will know the MPE value at distance 20cm. Ref. : David K. Cheng, Field and Wave Electromagnetics, Second Edition, Page 640, Eq. (11-133). 4 EUT Operating condition The software provided by Manufacturer enabled the EUT to transmit and receive data at lowest, middle and highest channel individually. 6. Classification The antenna of this product, under normal use condition, is at least 20cm away from the body of the user. Warning statement to the user for keeping at least 20cm or more separation distance with the antenna should be included in users manual. So, this device is classified as Mobile Device. Set both RBW and VBW of spectrum analyzer to 100 kHz with suitable frequency span including 100 kHz bandwidth from band edge. The band edges was measured and recorded. 4.6.4 DEVIATION FROM TEST STANDARD No deviation FCC ID: PY3WAG311 Report No.: RF920522H0158Issued: Jul. 09, 2003 ADT No.: 920522H01 4.6.5 EUT OPERATING CONDITION Same as Item 4.3.6 4.6.6 TEST RESULTS (A) The spectrum plots are attached on the following 2 pages. D1 line indicates the highest level, and D2 line indicates the 20dB offset below D2. It shows compliance with the requirement in part 15.247(C). NOTE (1): The band edge emission plot on the following first page shows 49.07dB delta between carrier maximum power and local maximum emission in restrict band (2.3458GHz). The emission of carrier strength list in the test result of channel 1 at the item 4.2 is 100.8dBuV/m, so the maximum field strength in restrict band is 100.8-49.07=51.73dBuV/m which is under 54 dBuV/m limit. NOTE (2): The band edge emission plot on the following second page shows 48.31 dB delta between carrier …
