This Remote Radio Unit multi-Standard (RRUS) is designed for use in GSM, WCDMA 1900 MHz cellular telephone system. The transmitter will operate in band 2 from 1930 MHz to 1990 MHz. The receiver circuit supports 1850 MHz to 1910 MHz. This Remote Radio Unit multi-Standard (RRUS) supports modulation type GMSK and 8PSK for GSM, and QPSK, 16QAM and 64QAM for WCDMA. The base station operates in the broadband PCS services as per 47 CFR Part 24 subpart E. It meets the requirements of 3GPP specification for operation in GSM, WCDMA and LTE cellular systems. This remote radio unit (RRUS) will in normal mode operates at a nominal power out of 20, 40 and 60 watts at the output connector. The Exhibit 8 user manuals submitted with this application is generic and may cover multiple products. This application is only valid for the model specified in the Exhibit 12 circuit description. Ericsson AB requests confidentiality under CFR 0.459 according to attached letter. We further certify that the applicant nor any party to the application is subject to a denial of Federal benefits, that includes FCC benefits, pursuant to section 5301 of the Anti-Drug abuse Act of 1988, 21 U.S.C. This due to the following reasons: Our base station equipment is non-consumer devices thus they are not sold to the general public. They are not serviceable by consumer but by us / our designated technicians. They are designed strictly based on the technical specifications of the international project 3GPP (the 3rd Generation Partnership Project). The competition in this field is very intense and a less advanced solution/design could get an unfair advantage by accessing the information as listed below from common domain. As we believe that we have implemented groundbreaking solutions and designs into our recent equipment compared to the previous equipment, the listed Exhibits/Items need to be protected from disclosure to our competitors in the industry. As the FCC/IC records have in-depth information and a very wide distribution, we believe that you can understand our concerns. We are strong in our belief that all vendors in the industry need to compete by their own merits. We regard these Exhibits/Items to be our intellectual property and therefore as confidential information. As our equipment are generally installed in restricted places, public access is not possible all thought some types of our equipment under certain circumstances can be installed in an unrestricted place, but our equipment are either key-locked or mast mounted and therefore can not be opened except by authorized personnel or inaccessible to general public. There are advanced technical and design solutions/information in the Exhibits/Items, as mentioned above, that we regard as Ericsson proprietary, with actual and potential patents pending. The information can be advantageous to our competitors as well as sources seeking ways to hack past the built in security functionality. These solutions or information thereof are not accessible even for our customers or partners unless non-disclosure agreements for particular item(s) have been signed. Confidential product information can be found in, but not necessarily limited to, internal photos of our equipment, block diagrams, schematics diagrams, and parts lists as well as certain documents, such as the user’s manuals. Those documents can only be accessible by the customers who purchase out BS and accept the conditions and therefore are provided with unique information access tools. Confidentiality. Each party agrees that all confidential documents, work product and information (including all computer code, internal photographs of products, block diagrams, schematic diagrams, technical and/or user manuals, related materials, and the existence of this Agreement) received or otherwise obtained from the other party pursuant to this Agreement, whether before or after the Effective Date, will be, and will be deemed to have been, received in confidence and will be used only for the purpose of carrying out the obligations of, or as otherwise contemplated by, this Agreement. In addition, each party agrees that public access to all confidential equipment supplied will be restricted either by installation of the equipment in a restricted area or by physically securing the equipment by other means, including, but not limited to, using a key-lock that can only be opened by authorized personnel. Without the other party’s prior written consent, neither party may disclose any such information to any third party or grant access to the confidential equipment to any unauthorized person, and each party will disclose such information only to such of its officers, employees and agents that have a need to know such information for the purposes contemplated hereby. However, the provisions of this Section will not apply to any such information that (i) is or becomes generally available to the public without the fault or negligence of either party, (ii) is already in the possession of the receiving party without being subject to another confidentiality obligation, (iii) is or becomes available to the receiving party on a non-confidential basis from a source other than the disclosing party; provided that such source is not bound by a confidentiality obligation of the disclosing party, (iv) is required to be disclosed pursuant to an arbitration proceeding conducted in accordance with this Agreement, or (v) is required to be disclosed pursuant to a requirement of any governmental authority or any statute, rule or regulation; provided that the party required to disclose such information of the other party provide to the other party notice of such requirement of any such disclosure and cooperates with the other party to prevent or restrict any such disclosure to the extent allowed by applicable law.
