However, the provisions of this Section will not apply to any such information that (i) is or becomes generally available to the public without the fault or negligence of either party, (ii) is already in the possession of the receiving party without being subject to another confidentiality obligation, (iii) is or becomes available to the receiving party on a non-confidential basis from a source other than the disclosing party; provided that such source is not bound by a confidentiality obligation of the disclosing party, (iv) is required to be disclosed pursuant to an arbitration proceeding conducted in accordance with this Agreement, or (v) is required to be disclosed pursuant to a requirement of any governmental authority or any statute, rule or regulation; provided that the party required to disclose such information of the other party provide to the other party notice of such requirement of any such disclosure and cooperates with the other party to prevent or restrict any such disclosure to the extent allowed by applicable law.

This Radio Unit (LPRU 4410 B5B13) is designed for use in LTE and NR cellular telephone system. The FDD transmitter and receiver will transmit from 869-894 MHz and 746-756 MHz. It supports channel bandwidths of 10 MHz for LTE. It also supports channel bandwidths of 20 MHz for NR. The Radio Unit supports modulation types QPSK, 16QAM, 64QAM and 256QAM. The Radio Unit operates in the Cellular Radiotelephone Service as per 47 CFR Part 22 and the746-758 MHz band as per 47 CFR Part 27. It meets the requirements of Third Generation Partnership Project (3GPP) for operation in LTE and NR cellular systems. The LPRU 4410 B5B13 product will only be installed with its RF output ports connected to Active Distributed Antenna Systems (DAS). Our product will not be directly connected to antennas. The Radio Unit will in normal mode operate at a nominal power output of 50 mW per port at the output connectors (8 connectors with up to 50 mW in each port). This Radio Unit (LPRU 4410 B5B13) will always require a license for transmission. The Exhibit 8 user manuals submitted with this application are generic and may cover multiple products. This application is only valid for the model specified in the Exhibit 12 circuit description. Ericsson AB requests confidentiality under CFR 0.459 according to attached letter.
