Long term confidentiality under special conditions Long term confidentiality under special conditions is requested for Exhibit 8 (Manuals) and Exhibit 9 (Internal Photos) according to KDB 726920 D01 Confidentiality Request Procedures v01r02. 1.1 Justification We, Ericsson AB, apply for that User Manuals and Internal Photos should be withheld from public inspection in accordance with Sections 0.457 and 0.459 of the Commission’s Rules based upon: • The product in question (Remote Radio Unit, Radio, 3GPP Base Station) is a none consumer device. • The product type (Radio) is located in such a way that it’s not accessible for the general public, e.g. (but not limited to) in a RBS antenna mast or on a RBS antenna tower or on a building outside wall or on a building roof.... • The product in question is only handled (purchased / used) by professional businesses and customers to Ericsson. • Certain product information, including but not limited to, Exhibit 8 (User Manuals) and Exhibit 9 (Internal Photos) will only be available to Ericsson's customers during/past customer purchase of such Ericsson products. • Such information, including but not limited to, User Manuals and Internal Photos, is not (and will not be) public available unless violation of None Disclosure Agreements (NDA). • Ericsson prevents that sensitive information, including but not limited to, User Manuals and Internal Photos, not is disclosed to unauthorized parties, via NDA. All customers to Ericsson, purchasing Ericsson equipment, have to agree upon / sign such NDA. • Information covered by such NDA, including but not limited to, User Manuals and Internal Photos, is by Ericsson considered as confidential commercial Confidentiality Class External Confidentiality Label Document Type Page Ericsson Confidential 3 (3) Prepared By (Subject Responsible) Approved By (Document Responsible) Checked EALIAFR Afrah Ali Sadiq Document Number Revision Date Reference A 2023-04-05 information and is not known to the public nor to competitors to Ericsson. Such information can, if disclosed, be used by competitors to Ericsson to obtain commercial/technical gain. • Ericsson acts in a very fierce competitive market. The competition in this field is very intense and a less advanced solution/design could get an unfair advantage by accessing product related information (not known to the public nor to competitors to Ericsson) easily from an open domain with worldwide access. • The product in question is the latest Ericsson Radio Unit, designed to effectively fulfill both existing regulatory requirements and customer specific requirements. • We strongly believe that the information together is sensitive from trade secrets point of view and should be held long term confidential, preventing access from unauthorized parties (e.g. from competitors to Ericsson). • Specially, but not limited to, Internal Photos: A competitor to Ericsson can from internal photos extract vital information that reveals design related secrets. This due to the following reasons: Ericsson Base Stations (BS) are designed strictly based on the technical specifications of the international project 3GPP (the 3rd Generation Partnership Project). The competition in this field is very intense and a less advanced solution/design could get an unfair advantage by accessing the information as listed below from common domain. As we believe that we have implemented groundbreaking solutions and designs into our recent BS/Radio Unit (RU) / Remote Radio Unit (RRU) / Radio Dot (RD) compared to the previous BS/RU/RRU/RD, the listed Exhibits/Items need to be protected from disclosure to our competitors in the industry. As the FCC records have in- depth information and a very wide distribution, we believe that you can understand our concerns. We are strong in our belief that all vendors in the industry need to compete by their own merits. We regard these Exhibits/Items to be our intellectual property and therefore as confidential information. There are advanced technical and design solutions/information in the Exhibits/Items, as mentioned above, that we regard as Ericsson proprietary, with actual and potential patents pending. The information can be advantageous to our competitors as well as sources seeking ways to hack past the built-in security functionality. These solutions or information thereof are not accessible even for our customers or partners unless non-disclosure agreements for particular item(s) have been signed. Confidential product information can be found in, but not necessarily limited to, internal photos of the BS RU RRU and RD, block diagrams, schematics diagrams, and parts lists as well as certain documents, such as the user’s manuals. Those documents can only be accessible by the customers who purchase out BS/RU/RRU/RD and accept the conditions and therefore are provided with unique information access tools. Outside of these compliance boundaries, the radio frequency (RF) exposure levels are below the limits specified by the Federal Communications Commission (FCC) [1]. The tests were performed by calculations in accordance with the Ericsson RF exposure calculation procedure for base stations [2], which is in conformity with the FCC OET Bulletin 65 [3] and IEC 62232:2017 [4]. It should be noted that the test results presented in this test report are valid for the frequency range specified in Table 1, for the antenna properties specified in Table 2, and for the power level, power tolerance, and transmission loss specified in Table 3. These data as well as the applied antenna pattern files were supplied by the client and may affect the validity of the results. Proposed EMF health and safety information for inclusion in the Customer Product Information (CPI) is provided in Appendices A, B and C. 2 Equipment under test Table 1 and Table 2 below summarize the technical data for the equipment under test (EUT) and the properties of the antenna. Table 3 lists the maximum nominal output power from the radio unit (total peak power from all antenna branches) and the total time-averaged power delivered to the antenna for the specified configuration. The total time-averaged power delivered to the antenna includes transmission loss and output power tolerance. The EUT related data in Tables 1-3 were supplied by the client.
