(“UNOWHY”) guarantees the QOOQ tablet hardware and accessories contained in the original packaging which can be identified by the trademark “UNOWHY” and/or the trademarks or tradename “QOOQ” and have the “UNOWHY” and/ or “QOOQ” logo affixed to them (“Products”) against defects in materials and workmanship when used normally in accordance with UNOWHY’s instruction manual, inserts together with the original packaging for the Product or any service communications e-mailed or mailed to you (the “Published Guidelines”) for a period of two (2) years from the date of original retail or online purchase by the end-user purchaser (“Warranty Period”). CE QUI EST COUVERT PAR CETTE GARANTIE Unowhy US, Inc. (désigné ci-après par « UNOWHY ») garantit le matériel et les accessoires de la tablette QOOQ, contenus dans son emballage d’origine, pouvant être identifiés par les marques déposées « UNOWHY » ou « QOOQ », ou par l’appellation commerciale « QOOQ » ainsi que par les logos de ces marques apposés sur ces produits (désignés ci-après par « produits »), contre tout vice de fabrication ou de matériau, dans des conditions normales d’utilisation, conformes au manuel d’instructions publié par UNOWHY inclus dans l’emballage d’origine du produit, ou conforme à toute communication qui vous aura été adressée par courrier électronique ou postal (« Instructions d’utilisation publiées ») et ce, pour une période de (2) ans à compter de la date d’achat chez un revendeur ou en ligne par l’acheteur final (« Durée de la garantie »). * * * WHAT IS NOT COVERED BY THIS WARRANTY? This warranty does not apply to any non-UNOWHY or non-QOOQ branded hardware products or any software, even if packaged or sold with the Products. Manufacturers, suppliers, or publishers of these other products or software, other than UNOWHY, may provide their own warranties to you – please contact them for further information. Software distributed by UNOWHY (including, but not limited to Product system software) is not covered by this warranty. Please refer to the licensing agreement accompanying the software for details of your rights with respect to its use. THIS WARRANTY DOES NOT APPLY TO (a) damage caused by the use of the Product with other products not sold by UNOWHY; (b) damage caused by accident, misuse, or abuse of the Product; (c) damage caused by a force majeure event, such as flood, fire, earthquake or other external and unpredictable causes; (d) damage caused by the attempted repair or opening of hardware by a person who is not a representative of UNOWHY or an authorized service provider; (e) a product or part of the product that has been modified without the permission of UNOWHY; (f ) consumable parts such as batteries, unless damage is due to a manufacturing defect; (g) cosmetic damage such as scratches, scuffs, dents and broken plastic parts, which does not impact the functionality of the Product or its operation; (h) products with the serial number removed or made unreadable; (i) damage caused by commercial use of the Product ; (j) damage resulting from failure to follow the Published Guidelines. If a hardware defect arises and a valid claim is received within the Warranty Period, UNOWHY will, at its discretion, (i) repair the Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the Product with a device that is at least functionally equivalent to the Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) provide a full refund of your purchase price of the Product. In instances where warranty service does not require the Product to be opened (e.g. replacement of a backstand), UNOWHY may request that you replace certain user-installable parts yourself. A replacement part or Product, including a user-installable part that has been installed in accordance with instructions provided by UNOWHY, assumes the remaining term of the Warranty Period or ninety (90) days from the…
