May 2, 2002 Federal Communications Commission Authorization and Evaluation Div. Equipment Authorization Branch 7435 Oakland Mills Road Columbia, MD 21046 In re: Samsung Electronics Co., Ltd. FCC ID.: A3LSPHA540 Request for Confidentiality To Whom It May Concern: In accordance with 0.459 of CFR 47, Samsung Electronics Co., Ltd. requests confidentiality for the Block Diagram, Schematics, Parts list, Tune-up Procedure, Operational and Circuit Description of the attached test report. These documents contain detailed system and equipment descriptions and related information about the product, which Samsung Electronics Co., Ltd. considers to be proprietary, confidential, and a custom design and otherwise, would not release to the general public. Since this design is a basis from which future technological products will evolve, Samsung feels that this information would be of benefit to its competitors, and that the disclosure of the information in these documents would give our competitors an unfair advantage in the market.
February 4, 2002 Federal Communications Commission Authorization and Evaluation Div. Equipment Authorization Branch 7435 Oakland Mills Road Columbia, MD 21046 To whom it may concern: We, the undersigned, hereby authorize PCTEST Engineering Laboratory Inc., to act as agent on behalf of all matters relating to applications for equipment authorization, including the signing of all documents relating to these matters. Any and all acts carried out by PCTEST Engineering Laboratory, Inc. on our behalf shall have the same effect as acts of our own. We also hereby certify that no party to this application is subject to a denial of benefits, including FCC benefits, pursuant to Section 5301 of the Anti-Drug Abuse Act of 1988,21 U.S.C.862. Sincerely, Wallace Oh Engineering Manager Samsun Electronics America May 2, 2002 Federal Communications Commission Equipment Approval Services 7435 Oakland Mills Road Columbia, MD 21046 SUBJECT: FCC E911 REQUIREMENTS PER §22.921 Gentlemen: Samsung Electronics Co., Ltd. hereby certifies that the analog cellular telephone (FCC ID: A3LSPHA540), using the Automatic A/B Roaming — Intelligent Retry method, meets the E911 requirements specified in Section 22.921 of the FCC Rules. This procedure recognizes when a “9-1-1” call is made and, at such time, will override any programming in the mobile unit that determines the handling of a non-911 call and permit the call to be handled by other analog carriers. Should you have any questions or comments concerning the above, please contact the undersigned. AFFIDAVIT FOR ESN PROTECTION OF CELLULAR MOBILE TELEPHONES We hereby certify that the Portable Cellular Telephone (FCC ID: A3LSPHA540) is so designed that it complies with all the requirements for ESN protection specified in Sec.22.919 of the FCC Rules. a) The transmitter in service has a unique ESN. b) The ESN host component is permanently attached to a main circuit board of the mobile transmitter and the integrity of the unit operating software cannot be altered. The ESN is plated from fraudulent contact and tampering. The ESN is encoded using multiplication by a polynomial and the ESN data programmed in the memory with other information. c) The ESN is factory set and cannot be altered, transferred, removed or otherwise able to be manipulated. Cellular mobile equipment is specifically designed such that any attempt to remove, tamper with, or change the ESN chip, its logic system, or firmware originally programmed by the manufacturer will render the mobile transmitter inoperative. June 14, 2002 Federal Communications Commission Authorization and Evaluation Division 7435 Oakland Mills Road Columbia, MD 21046 Att: Richard Fabina Chief, Equipment Authorization Branch Re: SAR Report submitted with FCC ID: A3LSPHA540 Confidentiality Request Gentlemen: Pursuant to Sections 0.457 and 0.459 of CFR Title 47 FCC Rules and Regulations, PCTEST Lab request confidentiality for the SAR report submitted as an attachment(s) to the subject application for certification for the reference FCC ID: A3LSPHA540. The attachment(s) to the application is (are) identified as "PCTEST Operational Description SAR Report" is marked confidential. This report contains trade secrets and commercial information that are customarily guarded from competitors and are never released to the public. Section 0.457(d)(2) stipulates that such material will be withheld from routine inspection if it is shown that the material contains the type of information specified in the preceding statement. Specifically, the PCTEST Operational Description SAR Report contains processes and procedures developed by PCTEST Lab that enable RF Exposure tests performed at PCTEST Lab to meet the stringent requirements of the most recent FCC released Supplement C guidelines for performing such measurements. Disclosure of this information to competitors will result in material harm to PCTEST Lab. PCTEST Lab is currently reviewing the document for which they requested confidentiality to insure that it conforms to the requirements of the FCC rules for withholding information. Test data that is contained in the report has been left in to facilitate review of the report by the FCC. However, the test data contained in this section has been duplicated and submitted in a public file along with the SAR plots. The “PCTEST Operational Description SAR Report” contains confidential business information that PCTEST Lab does not release to the public and accordingly does not wish to have made available to the public via the FCC files. PCTEST Lab is aware that the issue of confidential treatment of this report is under review by the OET legal counsel and possibly by the Office of General Counsel of the Commission. Pending a decision by the appropriate authorities, PCTEST Lab will continue to request confidential treatment of the file identified as “PCTEST Operational Description SAR Report”. If the determining authority decides this information cannot be held confidential, PCTEST Lab will inform the Lab as to their intentions to appeal that decision or accept the decision. In the event the decision is accepted by PCTEST Lab, we will not pursue continued confidential treatment of the report and will assist the Lab in any way possible regarding correcting existing records. In compliance with the provisions of Section 0.457(d) stipulating that test measurements will be made available to the public following the effective date of the authorization, PCTEST Lab has separated the measurement data required to show compliance with the RF Exposure requirements in a separate file identified as "SAR Measurement Data" that will be available for public inspection following the effective date of the authorization. Please contact the undersigned by telephone at 410-290-6652, or by email at [email protected] or by correspondence at the above address if there are any further questions or additional information needed concerning this request for confidentiality. Regards,
July 26, 2002 Federal Communications Commission Equipment Approval Services 7435 Oakland Mills Road Columbia, MD 21046 Re: Withdrawal of Confidentiality Request FCC ID: A3LSPHA540 Gentlemen: PCTEST TCB has removed or is removing the check mark from the confidentiality request box for the reference item in compliance with your request. This action insures that all requests and other issues raised by the Commission in regard to their post grant review of this application has been addressed. In regard to the original request for confidentiality of the subject business documents, it is understood that such a request should be addressed through a different venue. Accordingly, we are withdrawing the confidentiality request and the test firm, in this case PCTEST Lab, is considering addressing the confidentiality issues directly as a policy matter with the Commission. Should you have any questions or comments concerning the above, please contact the undersigned.

SAR TEST DATA SUMMARY See Measurement Result Data Pages Procedures Used To Establish Test Signal The handset was placed into simulated call mode (AMPS, Cellular CDMA & PCS CDMA modes) using manufacturers test codes. Such test signals offer a consistent means for testing SAR and are recommended for evaluating SAR [4]. When test modes are not available or inappropriate for testing a handset, the actual transmission is activated through a base station simulator or similar equipment. See data pages for actual procedure used in measurement. Device Test Conditions The handset is battery operated. Each SAR measurement was taken with a fully charged battery. In order to verify that the device was tested at full power, conducted output power measurements were performed before and after each SAR measurement to confirm the output power. If a conducted power deviation of more than 5% occurred, the test was repeated.
