The above system has passed the proposed new mask outlined in the FCC NPRM Docket # 99-327 adopted November 4, 1999 and released November 10, 1999 and Erratum to the same rulemaking released December 23, 1999. Our system however has passed all the FCC Part 101 current requirements except for FCC Part 101.111 emission limits section. Based on our discussion with Mr. Michael Pollak from FCC DC Office on March 30 th , 2000, it has been agreed that a waiver for the current emission mask will be granted to Hughes Networks Systems under the condition that we pass the new proposed FCC emission limits. Therefore Hughes Networks Systems is asking for a waiver to operate their product in the 24 GHz DEMS service band. A similar waiver has been granted to NORTEL/TELIGENT to operate their product in the DEMS band. Confidentiality Request The part of the above application has been requested confidentiality. The reason for this is that two exhibits (EXHIBIT 5 & EXHIBIT 8) contain detailed schematics that could lead to technology patent disclosure. The technology is very new and therefore all precautions have to be taken to keep this information confidential from public access. 2.
