The FCC to number for this product is KKG50416. The product is an underground low frequency magnetic field transmitter and is part of a system that is used for guiding and fluid pressure monitoring purposes in a horizontal directional drilling operation. The DigiTrak® F5Dp 19/12 and F5Dp 12/1.3 transmitters are electrically and mechanically identical to each other. The power requirement, power output, and modulation are the same as well as the method, equipment, and materials used in the manufacture. The devices differ only in labeling and frequency of operation (F5Dp 19/12 operates at either 19 kHz or 12 kHz, the F5Dp 12/1.3 operates at either 12 kHz or 12 kHz and 1.3 kHz simultaneously). The F5DLp 19/12 differs from the F5Dp models in the length of antenna, thus the output power and power consumption (battery life) are also different. The F5DLp 19/12 is 19" (48.26 cm) long and with a specified transmitting range of 85 It (25.9 m) where the F5Dp 19/12 and F5Dp 12/1.3 are 15" (38.1 cm) long with a specified transmitting range of 65 It (19.8 m). The F5Dp 19/12 and F5DLp 19/12 models are identical in frequency and modulation as well as the method, equipment, and materials used in the manufacture. Significant engineering resources were expended designing the pa11s of the product shown in the schematics, frequency block diagram, and operational description. It is our belief that it would be difficult to reverse-engineer the product from publicly available information (including the product itself). Substantial competitive harm to us could therefore result should these documents be made available to the public. We face both domestic and foreign competition in our market (locating equipment for horizontal directional drilling), including product piracy (attempts at direct knock-offs). Disclosure of the documents listed above would provide our competitors and potential product pirates with an unfair competitive advantage, by allowing them to copy our technical solutions without the development expense. We protect this infOimation through the following primary procedures: (I) all employees and contractors are required to sign nondisclosure agreements, as are any visitors, vendors or other third parties who may be exposed to any confidential information, and (2) the information is only provided to employees and third parties on a "need to know" basis. The information is not publicly available, and is not included in our operating manuals or on our website. We are not aware of the infonnation listed above having been disclosed to any third party not bound by a nondisclosure agreement. The materials listed above should not be available for public disclosure at any time. Our products can remain in service for extended periods of time (more than ten or fifteen years), and the rate of significant technological change in our industry is sufficiently slow that even the copying by our competitors of technical information from many years in the past could result in the creation of a product that might be competitively harinful to us. Test reports made by an overseas laboratory that has been accredited for the relevant standards by an overseas accreditation body that has a Mutual Recognition Agreement (MRA) with NATA are also accepted as technical grounds for product conformity.
