Data may be delayed, corrupted (i.e., have errors) or be totally lost. Although significant delays or losses of data are rare when wireless devices such as the Sierra Wireless modem are used in a normal manner with a well-constructed network, the Sierra Wireless modem should not be used in situations where failure to transmit or receive data could result in damage of any kind to the user or any other party, including but not limited to personal injury, death, or loss of property. Sierra Wireless accepts no responsibility for damages of any kind resulting from delays or errors in data transmitted or received using the Sierra Wireless modem, or for failure of the Sierra Wireless modem to transmit or receive such data. Safety and hazards Do not operate the Sierra Wireless modem in areas where blasting is in progress, where explosive atmospheres may be present, near medical equipment, near life support equipment, or any equipment which may be susceptible to any form of radio interference. In such areas, the Sierra Wireless modem MUST BE POWERED OFF. The Sierra Wireless modem can transmit signals that could interfere with this equipment. Do not operate the Sierra Wireless modem in any aircraft, whether the aircraft is on the ground or in flight. In aircraft, the Sierra Wireless modem MUST BE POWERED OFF. When operating, the Sierra Wireless modem can transmit signals that could interfere with various onboard systems. Some airlines may permit the use of cellular phones while the aircraft is on the ground and the door is open. Sierra Wireless modems may be used at this time. The driver or operator of any vehicle should not operate the Sierra Wireless modem while in control of a vehicle. Doing so will detract from the driver or operator's control and operation of that vehicle. In some states and provinces, operating such communications devices while in control of a vehicle is an offence. Please base upon the antenna gain information and submit MPE estimate in a separate file. In addition, please based upon the measured output power to valid the max. allowed antenna gain Vs the output power limits. [Danielle] The antenna gain has been revised in the report to be 4.65 dBi for the Cellular band and 3.35 dBi for the PCS band. MPE has been re-calculated too. Please see revised report as attached below. 05U3389-1_FCC 22 & 24_Revised ... Question #4: The max. measured RF conducted output power for Cellular band is 29.84dBm and 29.65 dBM for PCS band. These two measured output power do not agree the rated output power in page 11 of hardware integration guide. Please explain the differences. [Danielle] The output power 24 dBm listed on page 11 of hardware integration guide is average power. New test results on the average power are 25.58 dBm for the Cellular band and 25.72 dBm for the PCS band. Are these new data acceptable? Please see revised report as attached. Two proposed FCC ID label format are included in the filing. One of label is to be placed on the daughter card for the development kit and the other label is to be placed in the Reference Guide. Refer to FCC ID label format and location file. 7 The modular transmitter is manufactured so that the user cannot influence the operation of the transmitter that will operate outside of the scope of the regulations. Refer to “User’s Guide, Reference Guide, and Development Kit User’s Manual” Exhibit 8 Address compliance with the Commission's RF exposure limits in Sections 1.1310 and 2.1091. This Mini-PCI express CDMA Modem module will be installed in a host product where the transmitting antenna can provide 20 cm separation distance to the body of user. This module is sold to OEM and will only be installed by OEM or OEM authorized installer. Install this module in a portable configuration is not allowed unless proper equipment authorization has obtained. 2 The maximum antenna gain to allow compliance with RF exposure requirements is listed on the Grant of Certification for the module The antenna gain including cable loss must not exceed 4.65 dBi in Cellular Band and 3.35 dBi in PCS band , for purposes of 2.1043 and 2.1091. Above MPE estimate is based upon the measured peak conducted output power. 3 The licensed module must have a FCC ID label on the module itself. That FCC ID label must be visible through a window on the final device or it must be visible when an access panel, door or cover is easily removed.
