Compliance Certification Services and hereafter referred to as CCS, to act on our behalf in all manners relating to application for equipment authorization, including signing of all documents relating to these matters. Any and all acts carried out by CCS on our behalf shall have the same effect as acts of our own. We, the undersigned, hereby certify that we are not subject to a denial of federal benefits, that includes FCC benefits, pursuant to Section 5301 of the Anti-Drug Abuse Act of 1988, 21 U.S.C. 853(a). In authorizing CCS Testing Division as our agent, we still recognize that we are responsible to: a) comply with the relevant provisions of the certification program; b) make all necessary arrangements for the conduct of the evaluation, including provision for examining documentation and access to all areas, records (including internal audit reports) and personnel for the purposes of evaluation (e.g. testing, inspection, assessment, surveillance, reassessment) and resolution of complaints; c) make claims regarding certification only in respect of the scope for which certification has been granted; d) do not use our product certification in such a manner as to bring the Certification Division into disrepute and not make any statement regarding our product certification which the Certification Division may consider misleading or unauthorized; e) upon suspension or cancellation of certification, discontinue use of all advertising matter that contains any reference thereto and return any certification documents as required by the Certification Division; f) use certification only to indicate the products are certified as being in conformity with specified standards; g) endeavor to ensure that no certificate or report nor any part thereof is used in a misleading manner; h) ensure that any reference to our product certification in communication media such as documents, brochures or advertising, complies with the requirements of the Certification Division; i) keep a record of all complaints made known to the us relating to the product’s compliance with requirements of the relevant standard and to make these records available to the Certification Division when requested; j) take appropriate action with respect to such complaints and any deficiencies found in products or services that affect compliance with the requirements for certification; k) document the actions taken. It appears as though some of the exhibits submitted for this application may actually belong to other devices. The FCC ID listed on the application Form 731 and label is N7N- MC5725U, where the FCC ID listed in the Users Manual is N7N-AC595U. The Confidentiality and Short-Term Confidentiality letters shows FCC ID: N7N-MC5725 (without the 'U', which represents an already approved device). Please verify that the Users Manual submitted in this application is the correct manual for this device and replace as necessary. <Answer> New updated and revised User's Manual is attached. 2. The External Photographs submitted show a USB computer connected host device, but the application seem to imply that the EUT is a MC5725 module with a 52 pin edge connector. Please clarify which part of the device is the EUT. <Answer> The external photos are correct. The EUT is a USB device; it is a Wireless USB CDMA modem module. 3. The confidentiality letters indicates a request to have the Declaration of Similarity letter held confidential; however there is no such exhibit. This problem may be related to the issue of the FCC ID number above (it may be the wrong letter). <Answer> Please see new short and long term confidentiality letter, attached. 4. The letter of authorization in the Pt. 15 application is the correct CCS format but is more than 1 year old. The letter of Authorization in the Pt.22/24 application is less than 1 year old, but is no in the correct CCS format. Please provide a CCS format letter of authorization dated within a year of the filing of this application. <Answer> Please see new Authorization Letter, attached. 5. According to the NVLAP web site, the NVLAP accreditation 200065-0 is for the facility located at 561F Monterey Rd, Morgan Hill. According to the test report the testing was performed in the new facility located at 47173 Benicia St., Fremont. Please indicate if this new facility is covered under the same accreditation or a separate accreditation. <Answer> The new facility is covered under the same accreditation according to the Engineering Manager, Michael Heckrotte. 6. The SAR test report table of contents indicates that section 8 of the test report is a tabulation of the SAR test results; however, section 8 is missing from the SAR test report. Please submit an updated SAR test report to include the tabulated SAR test data. <Answer> The SAR Report is complete, but was submitted in 2 parts, because of the client's confidentiality request. The pages with photos have been extracted from the original 2 Report and removed. Attached is the complete report, without the pages extracted. The attachments remain as originally submitted. Please note that the client has requested short term and long term confidentiality on this project. Thanks for your help and patience. Also, Chris, there is also an IC-CB application (AN07I1959) for this EUT. Sierra is wanting these grants as soon as possible.
