Customer Query We are in the process of making an application for FCC certification of a base station via a TCB, we would like to keep the installation manual as a confidential exhibit on the FCC equipment authorisation page as we consider this to be a confidential document, the document is marked as Proprietary and Confidential. The equipment we are making the application for is non consumer equipment that is installed in restricted access locations to which the general public will have no access. In addition as part of the agreement to purchase a Non Disclosure Agreement (NDA) will be signed between ourselves and our customer. We have reviewed KDB 726920 D02 and discussed with the TCB, the guidance requires that a signed NDA that documents the item in question is submitted as part of the justification for requesting confidentiality of the installation manual. The NDA’s we use are general documents that cover a large remit and do not specifically cover the installation manual but do cover all ‘Proprietary and Confidential’ items and other terms of business. Due to nature of the additional information contained in the NDA’s we use, we do not wish to submit such extensive information and ask if a formal attestation letter stating that all proprietary and confidential information we provide to our customers is covered by an NDA would suffice in lieu of providing a full Non Disclosure Agreement. FCC response on 09/12/2012 Submit your confidentiality request letter first; I can further guide you after reading the confidentiality request and the justification in accordance with FCC Publication No. 726920 D02, dated 12/21/2011... ---Reply from Customer on 09/19/2012--- Please find attached our request for permanent confidentiality of our installation manual and attestation letter regarding non disclosure agreements. FCC response on 09/19/2012 Attestation statements and confidentiality request acceptable.
