(3) explanation of the degree to which the information is commercial or financial, or contains a trade secret or is privileged: This material includes circuit diagrams and board layout information for the system. As such, this material is treated as highly confidential business information. (4) explanation of the degree to which the information concerns a service that is subject to competition: The material for which confidentiality is sought is employed in the design and manufacture of ultra-wideband communications and radar systems that is offered on a highly competitive basis. Disclosure would also offer competitors additional unwarranted insight into the state of product development thereby allowing such competitors an advantage that would not be available to unless they were working with TDC and had a non-disclosure agreement with TDC. (6) identification of any measures taken by the submitting party to prevent unauthorized disclosure: The information for which confidential treatment is sought is kept confidential by TDC and not made available to third parties except pursuant to non-disclosure agreements. (7) identification of whether the information is available to the public and the extent of any previous disclosure of the information to third parties: To the knowledge of those preparing this application, the information has not been disclosed publicly heretofore. The protection sought is narrowly drawn and pertains to certain specific implementations of ultra-wideband technology. (8) justification of the period during which the submitting party asserts that material should not be available for public disclosure: This material should not be disclosed for at least five years. Disclosure of the design information would lead to insights into both designs and manufacturing techniques and could have an adverse competitive effect for many years to come. (Time Domain is aware, for example, of competitors in both Asia and Europe for this application.) As this is industrial equipment, we expected the equipment to be used for more than five years in some cases. Application Overview This application seeks certification of an ultra wideband device under the FCC Waiver to Time Domain dated June 29, 1999. The UWB device is a through-wall radar. It is battery powered. The radar includes an integral antenna completely enclosed within the device. The device meets all requirements of the waiver, including the requirement to contain a dead man switch. Intertek Testing Services in Atlanta GA measured the device in accordance with the measurement procedures identified in the Waiver as well as the applicable section of Part 15.

Confidentiality of the internal photos cannot be granted if the device is sold to the general public. Will you sell the device only to parties that have confidentiality agreement with Time Domain? TDC Response: This device cannot be sold to the general public, it can only be sold to law enforcement and fire fighting/emergency rescue entities eligible for licensing on the public safety pool frequencies as set forth in Part 90 of the commission’s rules. In addition every customer must sign a terms and condition sheet that I have attached to this correspondence. 2) Section 3.2 of the Test report indicates that average measurements above 960 Mhz were made with 1 MHz RBW and 10 kHz VBW. Please make measurements with RMS detector per Section 15.521(d). TDC Response : This Device was designed and built to comply with the rules and measurement techniques in the waiver. We used the video filtering method as it was called out in the waiver. Therefore Section 15.521 does not apply for this filing. 3) Table 3.3.1 lists Antenna factors in dB(1/m) while tests were performed at 3 meters. Please correct/explain. TDC Response : The Antenna factor is expressed in units of dB per meter (a.k.a. dB (1/m) or dB/m). Measurements that were made at three meters were made using three-meter antenna factors. Mr. J. This table does not list a distance factor while tests were performed at 1 meter. Above 1 GHz, and RMS detector must be used. Please correct/explain accordingly. TDC Response : The measurements that were made at one meter were made using one- meter antenna factors. The limit was adjusted to correspond to a one-meter measurement distance. At three meters, the limit is 54. At one meter, the limit is 63.5 (calculated by using the inverse square law). Since the limit was adjusted to the one-meter distance, further correction using the distance factor was unnecessary. The video filtering method was used for above 1 GHz as it was called out in the waiver. 5) Test data in Table 3.3.3 listed measurements at 1 meter however; no distance correction factor was listed. Please correct/explain. Please explain limit. The peak limit is 0 dB EIRP. Provide compliance with this requirement. TDC Response : The measurements that were made at one meter were made using one- meter antenna factors. The limit was adjusted to correspond to a one-meter measurement distance. Our device should be filed under the waiver were this limit does not apply. 8) Provide measurement data showing compliance with 15.517(c) measurements above 960 MHz with RMS detector and RBW of 1 MHz. FORMATION OF CONTRACT A written Purchase Order is a request for an offer from you to purchase. By signing and returning the Purchase Order to us, you make an offer to purchase under these terms. If it is determined that the operation of this Product has caused harmful interference to other radio operations, the operator shall immediately contact Customer Service at Time Domain Corporation at 888-826-8378. Under terms of the FCC's waiver, users of this Product must understand that this Product must not cause harmful interference to other radio services and must accept harmful interference from other radio services. Additionally, the FCC requires users to: · Submit information to the FCC defining the geographic area in which the Product will be used; · Maintain a log detailing the location where the Product was used and the duration of operation; · Notify Time Domain of any intention to transfer control of the device to a third party, so that Time Domain may coordinate with the FCC. The user must not resell, lease, loan or otherwise transfer or dispose of the Product without first obtaining Time Domain’s written consent and if such consent is given, without first coordinating the transfer with the FCC through Time Domain. ACCEPTANCE OF PRODUCTS You accept the products ordered on the earlier of (1) two days after the date the products are delivered to you or (2) the date you first use the products. PRESERVATION OF TIME DOMAIN PROPRIETARY RIGHTS We own and retain all of our patents, trademarks, trade secrets, copyrights, designs, and other intellectual property rights (“Proprietary Rights”). The third party manufacturers of any non Time Domain components of the Product own and retain all of their Proprietary Rights in the component parts. Washington, DC 20006 Dear Mr. Hilliard: This is in response to the petition for waiver of Part 15 of the Commission's rules, filed on February 2, 1998, on behalf of Time Domain Corporation ("Time Domain"), to permit the authorization of an ultra-wideband system that will be used either as a covert communications system or to detect persons in a building environment. These systems will have an extremely wide bandwidth with a center frequency located near 2000 MHz. Specifically, you request a waiver of the prohibition against operation within the restricted frequency bands listed in 47 CFR § 15.205(a) and of the application of a pulse desensitization factor for measurements below 1000 MHz as required by 47 CFR § 15.35(a). In support of the waiver request, Time Domain asserts that the signals transmitted using its time modulation technique will comply with the general emission limits contained in 47 CFR § 15.209. In addition, Time Domain asserts that the signals from its devices will appear noise-like. Moreover, Time Domain states that except for sales to federal agencies subject to regulation by the National Telecommunications and Information Administration, any equipment produced under this waiver request shall be sold only to law enforcement and fire fighting/emergency rescue entities eligible for licensing on the public safety pool frequencies as set forth in Part 90 of the Commission's Rules. Time Domain also states that it shall maintain records of all entities to whom the equipment produced under the waiver request is sold and will promptly make those records available to the Commission upon request. Further, Time Domain states that operation of any equipment produced under this waiver will be subject to 47 CFR § 15.5, which among other things, require that such equipment accept any interference from and not interfere with any authorized radio service. As additional support for its waiver request, Time Domain indicates that the waiver should be limited to production of 2,500 units of its ultra-wideband system which will be divided among communication and radar systems and these systems will be widely dispersed among the United States and will be used intermittently. Finally, Time Domain states that even if all 2,500 units were to operate at the same time the total emitted power throughout the entire United States would be less than 5 watts. As the frequencies that will be used include several frequency bands allocated to the U.S. Government, we coordinated the waiver request with the National Telecommunications and Information Administration ("NTIA"). On June 15, 1999, NTIA informed us that the waivers can be granted with certain conditions. A copy of the NTIA letter and attachment setting forth the conditions is enclosed. It is a well-established principle that the Commission will waive its rules only if it determines, after careful consideration of all pertinent factors, that such a grant would serve the public interest without undermining the policy which the rule in question is intended to serve. See WAIT Radio v FCC , 418 F.2d 1153, 1157 (D.C. Cir. 1969). In discussing the treatment of requests for waivers of established rules, the court in WAIT Radio emphasized that the agency's discretion in applying general rules is intimately linked to the existence of "a safety valve procedure" to permit consideration of an application for exemption based upon special circumstances. Id . Indeed, the court considered a rule most likely to be undercut if it does not take into account "considerations of hardship, equity, or more effective implementation of overall policy...." Id . at 1159. After careful consideration we believe that the requested waiver will serve the public interest by allowing Time Domain to supply to police departments with a communications system that will provide law enforcement officers with a means of covert communication. Additionally, we believe that the requested waiver will serve the public interest by allowing Time Domain to provide radar systems that will enable fire and rescue departments to provide a system to their personnel to determine the location of persons inside damaged, burning or smoke filled buildings. Further, based upon the conditions specified in the waiver request, we believe that there is a low probability that harmful interference will be caused by these systems. Preventing interference to other radio services is the primary purpose of the standards in Part 15. Thus, it does not appear that the requested waiver would undermine the policy of our rules. Moreover, we believe that a limited waiver of our rules would, in this particular instance, be in the public interest because it will afford a real-world test of a new technology. The results of this test will create a record that will aid the Commission in making decisions regarding allowing ultra- wideband applications on a broader scale. We wish to emphasize that grant of this waiver request does not in any way imply that the Commission's rules will be amended to provide for the authorization and use of ultra-wideband devices. Nor should it be deemed in any way to prejudge the Commission's consideration of the issues involving the operation of ultra-wideband devices in any inquiry or rule making proceeding. Accordingly, under the authority contained in Sections 0.31(i) and 0.241(a) of the Commission's regulations, 47 CFR §§ 0.31(i) and 0.241(a), a waiver is hereby granted to Time Domain Corporation to permit it to market the ultra-wideband communications and radar systems described in its petition. The waiver is subject to the following conditions: 1) The marketing of transmitters under this waiver shall not exceed 2,500 units. The waiver is granted for a period of four years. TDC Response: The peak measurement with the resolution bandwidths of the inverse of the pulse width was also submitted with the test report for informational purposes only. 2) In the same document, the peak to average ratio of Section 15.35(b), shall not exceed 23 dB for the communication system and 26 dB for the radar system. Indicate compliance with the appropriate peak limit accordingly. TDC Response : The data to support this is supplied in the test report in Table 3.3-2 and 3.3-3 with the peak to average ration being well below (approximately 6 dB) the 26 dB limit for radar systems. 3) Please indicate the pulse repetition factor of the device as discussed.
