Pursuant to Sections 0.457 and 0.459 of the Commission’s Rules, we hereby request confidential treatment of information accompanying this application as outlined below: Exhibit Type File Name Schematic, Operating Description, Block Diagram, Parts List, User Manual TNE-400ULC1_Schem, TNE-400ULC1_OpDes, TNE- 400ULC1_BlkDia, TNE-400ULC1_PartsLst, TNE- 400ULC1_UserMan The above proprietary exhibits above are all trade secrets of Magnetek specifically the schematics and circuit layout, parts list and component selection, pictures that included the size and shape of the module, and Users Manual. All of these contain specific information including philosophy of standardizing throughout our products, and our proprietary protocols which are described in the manual. The above materials contain trade secrets and proprietary information not customarily released to the public. The public disclosure of these materials may be harmful to the applicant and provide unjustified benefits to its competitors. The RF module in question is housed within Magnetek products, and those products are supplied to the customer with a separate user’s manual. The applicant understands that pursuant to Section 0.457 of the Rules, disclosure of this application and all accompanying documentation will not be made before the date of the Grant for this application. The user’s manual is an internal document, which includes proprietary information including circuit details held confidential in other exhibits. The user’s manual is very technical and is not provided to the consumer as the consumer cannot service the device. It is solely used as a design guide for Magnetek engineers to use as a reference on how to correctly incorporate this module into Magnetek products only. Sincerely, Eugene Novak

Magnetek Inc. radio control products are used in industrial applications where safe operation is critical. As such, all Magnetek radio products come equipped with safety features to prevent un-commanded motion of the equipment being controlled. Any un-intended motion could result in serious injury or even death to others. For instance, if the operator moves out of radio range and the controlled machine stops receiving messages, a safety relay opens to de-power the equipment being controlled remotely. Without polling in this application, the equipment remains powered when the radio link is lost and serious injury or death could result. Typical international industry standards call for radio controlled equipment to be powered by redundant emergency stop safety relays 1 . These relays must remove power from the equipment being controlled within a maximum of 2 seconds of no c ommunication with the controlling device 1 . In order to maintain this communication link, polling of the link status is required. Magnetek, Inc. wishes to make use of 15.231(3) and 15.231(4) which allows operation during the pendency of the alarm condition in order to prevent serious injury or death to others. Sincerely, Eugene Novak 1 BS EN 13557:2003+A2:2008 annex C.3

The modular transmitter being submitted for approval complies with the following criteria: • The radio elements of the modular transmitter must have their own shielding • The modular transmitter must have buffered modulation/data inputs (if such inputs are provided) to ensure that the module will comply with part 15 requirements under conditions of excessive data rates or over-modulation. • The modular transmitter must have its own power supply regulation. • The modular transmitter must comply with the antenna and transmission system requirements of §§ 15.203, 15.204(b) and 15.204(c). The antenna must either be permanently attached or employ a ‘‘unique’’ antenna coupler (at all connections between the module and the antenna, including the cable). The ‘‘professional installation’’ provision of § 15.203 is not applicable to modules but can apply to limited modular approvals under paragraph (b) of this section. • The modular transmitter must be tested in a stand-alone configuration • The modular transmitter must be equipped with either a permanently affixed label or must be capable of electronically displaying its FCC identification number. • The modular transmitter must comply with any specific rules or operating requirements that ordinarily apply to a complete transmitter and the manufacturer must provide adequate instructions along with the module to explain any such requirements. A copy of these instructions must be included in the application for equipment authorization. • The modular transmitter must comply with any applicable RF exposure requirements in its final configuration. Sincerely, Eugene Novak

The measurement procedures of ANSI C63.4:2003 were utilized as specified in FCC Part 15, Subpart C, Section 15.31(a)(3) and IC RSS-GEN Section 4.1. 2. All radiated emissions measurements were performed on an Open Area Test Site (OATS), listed with the FCC and IC, in accordance with FCC Section 15.31(d) and IC Section 4.2. 3. The level of the fundamental field strength was recorded with a new battery installed in the EUT, in accordance with FCC Section 15.231(e) and IC Section 4.3(e). 4. All measurements were performed at the specified 3 meter test distance as required by FCC Section 15.31(f) and IC Section 7.25. 5. The EUT was rotated throughout 360 degrees for all radiated emissions measurements as specified in FCC Section 15.31(f)(5) and IC Section 4.3(h). 6. All readily accessible EUT controls were adjusted in such a manner as to maximize the level of emissions in accordance with FCC Section 15.31(g) and IC Section 4.3(h). 7. Appropriate accessories were attached to all EUT ports during the performance of radiated emissions measurements as required by FCC Section 15.31(i) and IC Section 4.3(d). 8. The EUT operated over the frequency range of 411 to 470 MHz, a total range of 59 MHz. Testing was performed with the device operating at 3 frequencies, 1 at the top, 1 in the middle and 1 at the bottom of the range of operation in accordance with FCC Section 15.31(m) and IC Section 4.3(f)(g). 9. The frequency spectrum was investigated from the lowest frequency generated in the device up to the 10 th harmonic of the highest fundamental frequency in accordance with FCC Section 15.33(a)(1) and IC Section 4.9. 10. All measurements were taken with a peak detector function as specified in FCC Section 15.35(a) and IC Section 4.4. The duty cycle, calculated in accordance with FCC Section 15.35(c) and IC Section 4.5, was applied to the peak readings in order to obtain the average value of emissions. The peak value of emissions was verified to meet the 20 dB requirement of FCC Section 15.35(b) and IC Section 7.2.1.
